Who Needs a License
In Florida, a real estate license is required to engage in real estate brokerage or sales activities. Under Fla. Stat. § 489.105, a "real estate broker" is defined as any person who, for another and for a fee, commission, or other valuable consideration, sells, exchanges, purchases, rents, or leases real property, or who negotiates or offers to negotiate the sale, exchange, purchase, rental, or leasing of real property.
A "real estate sales associate" must work under a broker and assist in these activities. Both roles require state licensure.
How to Get Licensed
Step 1: Pre-Licensing Education
Complete an approved 63-hour pre-licensing course (for sales associates) through the Florida Department of Business and Professional Regulation (DBPR).
Step 2: Examination
Pass the Florida Real Estate Commission (FREC) examination administered by DBPR.
Step 3: Application to DBPR
Submit your license application to the DBPR, Division of Real Estate, with proof of education completion, passing exam scores, and required fees.
Step 4: Broker Sponsorship
If applying as a sales associate, you must be sponsored by an active Florida real estate broker before your license becomes active.
