PART 1. - MAJOR MONETARY DONATIONS

Sec. 113.101. - Scope.

This Part establishes procedures for the receipt of monetary donations to the City which equal or exceed $500,000.

Sec. 113.102. - Acceptance.

All monetary donations to the City which equal or exceed $500,000, and any conditional terms related thereto, shall be accepted by resolution of the Council, except when the nature of the conditional terms would otherwise require their approval by ordinance. Unless otherwise approved by ordinance, monetary donations received under this Part shall be deposited in and assigned to the City's general fund.

Sec. 113.103. - Recognition.

It is the policy of the City to nurture and welcome major donations to the City that can be used to subsidize the various City activities and divisions, so as to permit ad valorem revenue to be utilized in some other fashion such as to provide enhanced services, or so as to limit the City's reliance upon fees. Therefore, it is the policy of the City to appropriately recognize major donors and to allow said donors to "adopt" or "sponsor" such activities and divisions as is reasonable and practicable.

PART 2. - NON-MAJOR MONETARY DONATIONS

Sec. 113.201. - Scope.

This Part establishes procedures for the receipt of monetary donations to the City which are less than $500,000.

Sec. 113.202. - Acceptance.

All monetary donations to the City which are less than $500,000 and any conditional terms related thereto, shall be accepted by the Mayor, except when the nature of the conditional terms would otherwise require their approval by ordinance. Unless otherwise approved by ordinance, monetary donations received under this Part shall be deposited in and assigned to the City's general fund.

Sec. 113.203. - Recognition.

It is the policy of the City to nurture and welcome all monetary donations to the City. Therefore, it is the policy of the City that the Mayor appropriately recognize all donors in any reasonable and practicable manner that is otherwise consistent with the ordinance code.

PART 3. - DONATIONS OF PERSONAL PROPERTY

Sec. 113.301. - Scope.

This Part establishes procedures for the receipt of all gifts to the City of personal property.

Sec. 113.302. - Acceptance.

All gifts to the City of personal property shall be accepted by the Mayor, except when the nature of any conditional terms would otherwise require their approval by ordinance. In considering the acceptance of all such gifts, the Mayor shall consider the safety of the use of said personal property, and shall ensure that a division of the City is responsible for the monitoring of the receipt, installation, and maintenance of the personal property.

PART 4. - RECEIPT AND DISTRIBUTION OF TICKETS OR PASSES TO EVENTS[1]

Sec. 113.401. - Scope.

This Part establishes procedures for the receipt and distribution of gifts to the City in the nature of admission to events and associated parking, transportation, vouchers or other affiliated access or services. In addition, the City has negotiated or entered into certain agreements or other arrangements or there are other situations where the City is generically provided a number of tickets or passes to events as a result of those agreements, arrangements or situations. Furthermore, the City recognizes that there are circumstances when persons or corporations desire City representation at events and presentations. In all such circumstances, the determination of the appropriate representative shall be the decision of the City.

Sec. 113.402. - Acceptance.

All gifts received and designated exclusively to the Executive Branch of the City, in the nature of admission to events, shall be accepted by the Mayor or designee. All gifts received and designated exclusively to the Legislative Branch of the City, in the nature of admission to events, shall be accepted by the Council President or designee. All gifts received and designated to the City of Jacksonville generally shall be accepted by the Mayor or designee on behalf of the City and distributed as stated in this Part.

Sec. 113.403. - Distribution.

All gifts of admissions to events and associated parking, transportation, vouchers or other affiliated access or services accepted by the Mayor or designee on behalf of the City in general shall be distributed equally between the Executive Branch and the Legislative Branch. The distribution of all gifts of admissions to events and associated parking, transportation, vouchers or other affiliated access or services designated exclusively to the Executive or Legislative Branch shall be made at the discretion of the Mayor or designee or the Council President or designee, respectively. However, in no event shall gifts of admissions to events received by the City be used for personal consumption by any elected official of the City or the spouse or child(ren) of any elected official of the City. The Mayor and Council President or their designee shall ensure that procedures are in place to document the receipt and distribution of all gifts covered by this Part, in accordance with Section 602.702, Ordinance Code. The Sports and Entertainment Officer shall provide the Council Secretary/Director with a report on or before the fifth day of every month detailing the total number of tickets, passes, vouchers or other event gifts for each event occurring within the next six months and the number of each ticket, etc. that the Council will receive or has received.

PART 5. - IN-KIND SERVICES DONATIONS

Sec. 113.501. - Scope.

This part establishes procedures for the receipt of in-kind services donations.

Sec. 113.502. - Acceptance.

Unless otherwise provided in the Code, all in-kind services donations may be accepted by the Mayor except that the following in-kind services donations shall require City Council approval prior to acceptance:

(a)

In-kind services for any capital improvement;

(b)

In-kind services that include the demolition, alteration, relocation, or removal of any portion of a statue, obelisk, or monument; or

(c)

In-kind services with a monetary value exceeding $100,000.

For purposes of this section the term "capital improvement" shall have the meaning defined in Chapter 126 of the Code.

Sec. 113.503. - Authorization and execution.

The Mayor and Corporation Secretary are authorized to execute appropriate instruments, including contracts and agreements, in connection with the acceptance or receipt of in-kind services donations under this Part, except for those in-kind services donations in this Chapter that require prior City Council approval.
