PART 1. - IN GENERAL
Sec. 123.101. - Scope.
For purposes of Section 123.102(c) only, the environmental fees are effective Countywide including within Baldwin and the beach community, and are also applicable to all units of local government including boards, commissions, enterprises and independent authorities.

Sec. 123.102. - Fees established.
Fees established for the Departments listed below are subject to the Annual Review of Fees provisions found in Section 106.112, Ordinance Code. An updated fee schedule shall be maintained electronically and can be accessed at the electronic address noted below. A schedule of fees can be reviewed during business hours in the Finance and Administration Department.

Ticket Surcharges
(1)
A per ticket "ticket user fee" of $2.50 on each ticket sold for each event in the Jacksonville Veterans Memorial Arena ("Arena") and Times-Union Center for the Performing Arts ("Times-Union Center"). The ticket user fees authorized by this paragraph shall increase annually by an amount equal to three percent of the prior year's ticket user fee. The ticket user fees collected pursuant to this paragraph shall be used only for capital expenditures and capital maintenance in relation to the Arena and Times-Union Center.
(2)
A per ticket "ticket user fee" of $3.25 (plus annual increases not to exceed those set forth under the terms of that certain lease dated September 7, 1993, as amended, between the City of Jacksonville and Jacksonville Jaguars, Ltd.), with such annual increases being implemented for NFL games on each ticket sold for such events held in Municipal Stadium. A per ticket "ticket user fee" of $2.50 shall apply to all other commercial events at Municipal Stadium utilizing the stadium bowl (the "Commercial Ticket User Fee"). Events of not-for-profit organizations at Municipal Stadium utilizing the stadium bowl shall be subject to a ticket user fee in an amount equal to 50 percent of the then current Commercial Ticket User Fee, which as of the enactment date of this Ordinance shall be $1.25 (the "Non-profit Ticket User Fee"). Both the Commercial Ticket User Fee and the Non-profit Ticket User Fee shall increase by an amount equal to three percent of the prior year's ticket user fee. The ticket user fees remitted to the City in connection with this paragraph shall be expended only for capital expenditures and capital maintenance for, or in relation to, Municipal Stadium and its support facilities and infrastructure in the immediate vicinity.
(3)
A per ticket "ticket user fee" of $2.50 on each ticket sold (plus annual increases not to exceed those set forth under the terms of that certain Amendment 14 to Lease between the City and Jacksonville Jaguars, LLC dated December 11, 2015) for each event in the Amphitheater and Covered Flex Field. The ticket user fees remitted to the City pursuant to this paragraph shall be deposited into the applicable Venue-Related Enterprise Fund as described in Section 111.135, Ordinance Code, and expended only for capital expenditures and capital maintenance, repairs and improvements in relation to the Amphitheater and Covered Flex Field.
(4)
A per ticket "ticket user fee" of $2.50 on each ticket sold for each event held in the Baseball Grounds of Jacksonville. The ticket user fee authorized by this paragraph shall increase annually by an amount equal to three percent of the prior year's ticket user fee. The ticket user fees remitted to the City pursuant to this paragraph shall be deposited into the applicable Venue-Related Enterprise Fund as described in Section 111.135, Ordinance Code, and expended only for capital expenditures and capital maintenance in relation to the Baseball Grounds of Jacksonville.
(5)
All of the foregoing ticket user fees authorized by Section 123.102(i), Ordinance Code, may be waived or reduced in connection with events of non-profit organizations with the prior written approval of the Chief Administrative Officer or Chief Financial Officer, with simultaneous copy to the Council Auditor.

Sec. 123.103. - Annual budgetary adjustments.
The directors of the departments responsible for the programs for which fees are established in Section 123.102, Ordinance Code hereby are authorized and directed to make annual reviews of the above fees, together with the Director of Finance and Administration, during preparation of each department's annual budget recommendation. Those directors shall apprise the Mayor each year during the preparation of any changes to those fees which may be appropriate in order for the respective departments to recover the actual costs of permits, materials and services and the appropriate average administrative and service costs necessary to make the above permits, materials and services available to the public. The Mayor shall include such changes as are necessary in his annual budget proposal to the Council pursuant to Part II, Chapter 106.

Sec. 123.104. - Establishment of new fees.
In the event the Mayor hereafter determines other departments within the executive branch in equity and sound fiscal practice also should charge public fees for permits, materials and services comparable to those established above, the Mayor shall include such proposed public fees in the annual budget proposal to the Council or shall request introduction of an appropriate ordinance to establish such fees.

Sec. 123.105. - Reserved.

Sec. 123.106. - Interest assessed on late payment and penalties.
There shall be interest accrued on Section 123.102(c)(4) fees unpaid after 30 days in the amount of 1.5 percent per month, calculated from the date of the invoice to and through the date paid.
Additionally, for any late fee provided by Section 123.102(c)(4), referred to collection, there will be a penalty schedule as follows:
EXPAND $50 (ticketable violation): 30—60 days after the date of fee invoice $200: 61—180 days after the date of fee invoice $500: more than 180 days after the date of fee invoice
Collections made pursuant to this Section will also include recovery by the City, via payment by the responsible party, of reasonable attorney fees should legal action by the City should be required.

Sec. 123.107. - Exemptions.
(a)
The Office of the State Attorney, Fourth Judicial Circuit, is exempt from the payment of fees required for rescue reports and fire incidents reports.
(b)
Not-for-profit organizations created pursuant to 501(C)(3) of the United States Internal Revenue Code are exempt from the payment of fees required for hospital/nursing food service annual permit fee.
(c)
Gold Star Families, who are Duval County Residents, shall be exempt from park admission fees as described in Section 123.102, Ordinance Code. A Gold Star Family is the immediate family member(s) of a fallen service member who died while serving in an active duty status. The Military Affairs and Veterans Department shall administer a program, to be locally known as the "Timothy Seamans Gold Star Family exemption program," whereby a Gold Star Family must apply annually for the waiver of park admission fees to various parks (including the annual passes, where applicable). Upon the completion of the application and verification by the Military Affairs and Veterans Department, the Parks, Recreation and Community Services Department will issue an annual pass for admission to all City parks to the Gold Star Family, which may be renewed annually subject to the administrative process created by the Military Affairs and Veterans Department in coordination with the Parks, Recreation and Community Services Department.

Sec. 123.108. - Military and Veterans' Appreciation Program; Reduction of certain park fees for military and veterans.
There is hereby approved and adopted within the City a "Military and Veterans' Appreciation Program." The Parks, Recreation and Community Services Department is authorized to reduce current daily admission fees by one-half for fees charged at Kathryn Abbey Hanna Park and Huguenot Memorial Park (which may be applied to car, pedestrian and biker admission but not on annual passes) for all active military service members, veterans, and their immediate family members (spouse and children with valid military identification), regardless of residency in Jacksonville. In order to qualify for the reduced admission fees, the active military service member or veteran (or their immediate family member), must produce at the park entrance at the time of admission a state issued military ID, DD214 ID, or veteran ID.

PART 2. - MOTION PHOTOGRAPHY PRODUCTION PERMITS
Sec. 123.201. - Short title.
This Part may be known and cited as the Jacksonville Motion Photography Permit Ordinance.

Sec. 123.202. - Purposes.
The purposes of this Part are to establish a one-stop permitting process for motion photography production endeavors on public property owned or controlled by or under the jurisdiction of the City of Jacksonville; to provide a means whereby acts otherwise prohibited by the Ordinance Code may be allowed during such productions, and to provide for an exemption from other Ordinance Code permit requirements in recognition of the economic impact of the motion picture and television industry.

Sec. 123.203. - Definitions.
The following words, terms and phrases, when used in this Part, shall have the meanings respectively ascribed to them in this Section, except where the context clearly requires otherwise:
(a)
Breaking News is defined as an event that is currently occurring or developing. This shall not apply to simulations or re-enactments orchestrated by print or electronic news or any scripted content.
(b)
City equipment is any tangible property, other than real property, purchased by public funds and utilized in the normal course and scope of providing governmental service by the City of Jacksonville.
(c)
City facility is any public street, sidewalk, place or building owned or controlled by or under the jurisdiction of the City of Jacksonville to include, but not be limited to, City parks and recreation facilities, including all grounds surrounding all sports complex facilities, and City Hall.
(d)
Commercial means film, video, digital, or other electronic media for sale or distribution to further business interests.
(e)
Executive Director is the Executor Director of the Office of Economic Development.
(f)
Film Commissioner is the Manager of the Film and Television Office in the Office of Economic Development.
(g)
Motion photography is the commercial taking of still, live, or motion picture production whether made on or by film, video, digital, or any other electronic device used to produce theatrical motion pictures, television, and streaming entertainment motion pictures, industrial motion pictures, television commercials, social media, internet-based content, animation, or print media, regardless of platform, utilizing City equipment or utilizing City facilities. This term shall include, and a production permit shall be required for, such commercial productions on private property not at a studio involving the erection of tents or other temporary structures or involving the use of pyrotechnics, explosives, or other incendiary devices. This term shall not include the shooting of such film at studios constructed for such purpose where no City equipment or City facilities are involved and shall not include any breaking news.

Production permit (also referred to herein as permit) is the permit required by this Part.

Sec. 123.204. - Executive Director.
The Executive Director, or designee, is hereby authorized to act as the agent for the City of Jacksonville in the receipt and processing of applications for production permits. After review and approval by the City, the Executive Director or designee shall issue the permit. With regard to motion photography production, no other City permits shall be required.

Sec. 123.205. - Permit required; suspension and/or revocation; violation.
(a)
No person shall film or take photos or do any other type of motion photography for any commercial purpose within a State or local publicly owned or controlled site, facility, or right-of-way within the City of Jacksonville without first obtaining a permit.
(b)
Exceptions. Nothing in this Section shall require any permit from:
(i)
Any individuals filming, taking photos, or videotaping only for their own personal or family use.
(ii)
Employees of print or electronic news media when filming breaking news events as previously defined.
(iii)
Any student of a secondary school or college or university when filming, taking photos, or videotaping for educational purposes while using a hand-held camera, one camera on one tripod (with the exception of such use on public transit and public transit platforms), hand-held props and/or hand-held equipment with a cast, crew, and personnel of three or fewer people who are:
(1)
Not asserting exclusive use of City owned or controlled property;
(2)
Not using prop weapons, fire, pyrotechnics, animals, prop vehicles, stunts, or actors in police, fire, or other emergency personnel uniform;
(3)
Not requesting parking privileges for production vehicles;
(4)
Not fighting, whether real or simulated;
(5)
Not using or projecting noise with profane, vulgar, or indecent language or other language in public that is likely to incite violence or panic;
(6)
Not creating noise which is frequent, habitual, or long, and plainly audible at a distance of 100 feet from the area where the individual is located;
(7)
Not filming or taking photos at State or local publicly owned or controlled property subject to contract by a private party;
(8)
Not simulating the use or sale of drugs; and,
(9)
Not otherwise requesting an exemption from the City's rules and regulations or engaging in conduct that would require an exemption from the City's rules and regulations.
(c)
No person shall advertise, engage in, participate in, and/or start any motion photography production unless a production permit shall first have been obtained from and signed by the Executive Director, or designee. Violation of this Section shall be punishable as a class "D" offense as defined in Section 632.101.
(d)
Failure to comply with the terms and conditions of the production permit once issued shall be grounds for immediate suspension of the production until such time as the noncompliance is remedied. The suspension shall be initially communicated orally, followed by a written suspension order. Continued failure to comply with the terms and conditions of the production permit may result in revocation of the permit. Continuation of the production in violation of the suspension and/or revocation shall be punishable as a class "D" offense as defined in Section 632.101.

Sec. 123.206. - Application for permit.
(a)
Any person seeking the issuance of a production permit shall file an application with, and on forms provided by, the Film Commissioner. Such application shall be filed not more than 180 days before, and not less than ten working days before the commencement of production. The application shall be signed, under oath, by an authorized representative of the applicant.
(b)
The application shall contain the following information:
(1)
Location(s) of the production.
(2)
Duration and type of the production.
(3)
Proof of general liability insurance coverage in a minimum amount of at least $1,000,000 with the City named as an additional named insured. The exact amount of the required general liability insurance coverage shall be determined by the City's Division of Risk Management based on the scope of activities involved in the production project.
(4)
Special effects to be utilized, especially incendiary or explosive devices. In addition, the application shall list the person in charge (pyrotechnician) of such special effects together with his qualifications and licensure by the applicable federal and/or State agencies.
(5)
Proposed utilization of City equipment.
(6)
Necessity for closures of public streets or sidewalks and for what duration.
(7)
A written summary or explanation of the portion of the production to be shot within the City of Jacksonville.
(8)
Number and type of vehicles and/or equipment and number of personnel to be on location with the production.
(9)
An agreement to pay for extraordinary services provided by the City.
(10)
Proof of workers' compensation coverage in an amount no less than the Florida statutory requirements and employers' liability coverage in an amount of $500,000 per accident.
(11)
An indemnification agreement, in a form provided by the City, wherein the applicant agrees to defend, indemnify and hold the City harmless.

Sec. 123.207. - Exemption from other Ordinance Code requirements; responsibility to comply with all applicable federal or State laws, rules or regulations.
(a)
Once a production permit has been signed and issued, and notwithstanding any other provisions of the Ordinance Code to the contrary, no other City permits shall be required for any of the activities forming a part of the production.
(b)
The provisions concerning assembly and facility use permits of the Ordinance Code, insofar as certain acts are required or prohibited, may be suspended in connection with the conduct of a production pursuant to this Part.
(c)
Notwithstanding any exemptions from the Ordinance Code granted in this Part, all applicants shall be responsible for complying with all applicable laws, rules or regulations of federal or State entities concerning the activities to be performed pursuant to the City permit issued pursuant to this Part.

Sec. 123.208. - Costs for extraordinary services.
The City shall recover direct costs for extraordinary services rendered in connection with a production. Such costs shall include, but not be limited to, charges for personnel and/or equipment committed in support of the production which are outside the normal scope of government services. Based on the information contained in the permit application, an estimate of these costs will be provided to the applicant prior to issuance of the permit. The City may require pre-payment of all or a portion of these estimated costs prior to issuance of the permit. At the conclusion of the production, actual costs below or in excess of the estimates will be refunded by the City or paid by the applicant, respectively.
