Sec. 198.101. - Definitions.

In this Chapter, unless the context otherwise requires:

(a)

Massage means the manipulation of the superficial tissues of the human body with the hand, foot, arm, or elbow, whether or not such manipulation is aided by hydrotherapy, including colonic irrigation, or thermal therapy; any electrical or mechanical device; or the application to the skin, scalp, hair or any other part of the human body of a chemical or herbal preparation; or the cleansing of the skin, scalp, hair or any other part of the human body.

Massage therapist means someone who is licensed under F.S. Ch. 480, to administer massages.

Sec. 198.102. - Massage services.

(a)

It shall be unlawful for any person to engage in or offer to engage in the massage of another for compensation unless the person giving the massage is licensed by the State pursuant to F.S. Tit. XXXII, and the massage is related to the profession for which the person giving the massage is licensed or unless the person giving the massage is an athletic trainer employed by or on behalf of a professional athletic team performing or training within this State.

It shall be unlawful for any person to hold oneself out to be a massage therapist unless licensed by the State as a massage therapist.

Sec. 198.103. - Hours of operation.

Massages by massage therapists, for compensation, shall not be given or offered between the hour of 10:00 p.m. and 6:00 a.m. the following day. Massages in state-licensed hospitals and hospices, or those massages provided by a massage therapist acting under the direction of a licensed medical provider or practitioner, shall be exempt from the restrictions on the hours of operation set forth in this Section.
