Chapter 225 - VEHICLE REPAIR RECORDS RETENTION

Sec. 225.101. - Definitions.

In this Chapter:

(a)

Major Component means any motor, engine, frame, or transmission of a motor vehicle or motorcycle.

(b)

Motorcycle means any motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor or a moped.

(c)

Motor Vehicle means any self-propelled vehicle not operated upon rails or guideway, moped, and all terrain vehicle, but not including any motorized scooter, any bicycle or electric personal assistive mobility device.

(d)

Repair means any physical or mechanical repair to a motor vehicle or motorcycle. Repair shall not include replacement or repair of windshield wipers, repair of tires, replacement of fluids and light bulbs, or the washing or detailing of a vehicle or motorcycle.

Sec. 225.102. - Record keeping requirements.

Any individual, business, partnership, or corporation engaged in the business of the repair, sale, trade, and/or purchase of motor vehicles shall, prior to performing any repair or sale, trade, and/or purchase of any motor vehicle, motorcycle or major component thereof:

(a)

Record the name, address and telephone number of the individual requesting the repairs or involved in the transfer of ownership,

(b)

Record the year, make, and model of the motor vehicle or motorcycle to be repaired, sold, traded, and/or purchased,

(c)

Record the vehicle identification number of the motor vehicle or motorcycle to be repaired, sold, traded, and/or purchased,

(d)

Record the date of repair or transaction.

Sec. 225.103. - Reporting and inspection.

(a)

All records made pursuant to Section 225.102 hereof shall be retained at the place of business for a period of one year from the date that the repairs and/or transactions are completed, and shall, upon request, be made available for inspection by any law enforcement officer of Duval County or of the State of Florida.

(b)

In the event a motor vehicle or motorcycle that is to be repaired, sold, traded, and/or purchased is determined to have no vehicle identification number, or an altered or removed vehicle identification number, the individual discovering that fact shall immediately notify the Jacksonville Sheriff's Office Communications Center Dispatch Section.

Sec. 225.104. - Penalties.

Any individual, business, partnership, or corporation failing to comply with any provision of this Section shall be guilty of a civil violation punishable by a civil penalty of up to $500 per violation. Second convictions of this Section within five years shall be punishable by civil penalties of $1,000 per violation. A third conviction of this Section within five years of the first conviction shall be punishable by a civil penalty of $5,000 per violation.
