PART 1. - ORGANIZATION
Sec. 30.101. - Establishment; Director of the Planning and Development Department.
There is established an executive department to be known as the Planning and Development Department (hereinafter referred to in this Chapter as "Department") which shall be responsible for: the planning activities of the Consolidated Government; administering and interpreting the Comprehensive Plan and the Zoning Code; assisting and making recommendations to the Council with respect to zoning matters; considering and making recommendations to the Planning Commission upon requests for exceptions, variances, and waivers to the Zoning Code; granting administrative deviations to the Zoning Code; coordinating and developing Jacksonville's Resiliency Strategy across all departments and with affiliated agencies; and for assisting with the reapportionment of Council districts as required by the Charter or as requested by the Council. The head of the Department shall be the Director of the Planning and Development Department (hereinafter referred to in this Chapter as Director) who shall be appointed by the Mayor and confirmed by the Council and shall serve at the pleasure of the Mayor. The Director shall have a master's degree from an accredited college or university, in public administration, urban planning or a related field or shall have ten year's professional and administrative experience in a managerial capacity, at least five of which shall be in an urban planning or a related field or shall have ten years' professional and administrative experience in a managerial capacity, at least five of which shall be in an urban planning agency or organization. Furthermore, the Department shall provide coordination, expertise and assistance in the furtherance of economic development within the City, and the Director shall directly report to the Chief Services Officer.

Sec. 30.102. - Office of Resiliency; Establishment; Responsibilities; Chief Resiliency Officer.
There is established within the Department an Office of Resiliency, which shall be responsible for:
(a)
The coordination, development, refinement, administration, integration, and communication of resilience policies and practices for the City;
(b)
The development and coordination of Jacksonville's Resiliency Strategy across all departments; and
(c)
Overseeing the coordination of high-priority resiliency projects, including securing funding for resiliency initiatives, monitoring, and reporting progress on those projects.
Within the Office of Resiliency, a full-time position of the Chief Resiliency Officer ("CRO") is hereby created, which shall operate under the authority of, and report directly to, the Director of the Planning and Development Department. The CRO shall be appointed by the Mayor and approved by the Council and shall serve at the pleasure of the Mayor. The CRO shall serve as the chief liaison for all City operations relating to resiliency and shall be responsible to the Director for the development and coordination of Jacksonville's Resiliency Strategy across all departments. The CRO shall meet the following minimum qualifications: a master's degree or higher, from an accredited college or university, in engineering, environmental sciences, biology, sustainability, planning, or a closely related field; and four (4) years of progressively responsible professional work experience in sustainability planning, resiliency planning, or a related field.

Sec. 30.103. - Definitions.
In this Chapter, unless the context otherwise requires:
City means the City of Jacksonville, excluding the Second, Third, Fourth and Fifth Urban Services Districts, except as to County planning functions.
General location means area or neighborhood to be served, but not site specific.
Long-range plans means plans which define needs from five years to ten years.
Resiliency Strategy means the plan developed by the City for creating the projects, programs, funding, management, and implementation goals for a resilient Jacksonville.
Short-range plans mean plans, which define needs for three to five years.

Sec. 30.104. - Functions.
The Department shall:
(a)
Conduct research studies, collect, compile and analyze socioeconomic data and prepare maps, charts and tables necessary for the accomplishment of its other functions and for use by governmental and private entities.
(b)
Assist the Planning Commission in the exercise of its responsibilities as the designated local planning agency on behalf of the City under the Local Government Comprehensive Planning and Land Development Regulation Act in the preparation, evaluation, review and amendment of the Comprehensive Plan.
(c)
Review proposed site locations for public facilities and other matters related to land use and area planning which are referred to the Department by the Mayor, other executive departments and agencies, the Council or an independent agency and submit to the referring agency an opinion on the referred matter within a reasonable time or as otherwise specified in the Code.
(d)
Review and approve proposed site plans for subdivisions, mobile home parks, multi-family residential structures, more than one principal structure on a lot and structures of 40,000 square feet gross floor area or larger.
(e)
Assist the Planning Commission in the exercise of its responsibilities under Part 6, Chapter 122, Section 126.105 and other laws.
(f)
Administer, interpret and enforce the comprehensive plan, and assist and make recommendations to the Planning Commission in the preparation, evaluation and review of the comprehensive plan for the City, and amendments and modifications thereto, as required by Chapter 650.
(g)
Administer, interpret and enforce the Zoning Code and receive, review and make recommendations upon requests for exceptions, variances and waivers to the Zoning Code, grant administrative deviations to the Zoning Code and provide technical staff assistance to the Planning Commission, the Council and its committees with respect to the rezoning of land and, through the Director, make recommendations to the Council and its committees on matters related to zoning.
(h)
Prepare capital improvement programs and assist the Planning Commission in the preparation of the Capital Improvements Element of the Comprehensive Plan.
(i)
Coordinate comprehensive plans for the generation and transmission of electricity and water and sewer services to assure consistency with comprehensive planning.
(j)
Prepare, monitor and update all short-, medium- and long-range plans for the following:
(1)
The use of land and water areas and air space for residential, commercial, industrial and other purposes.
(2)
The general location and development of educational, recreational and other public facilities.
(3)
Housing, neighborhood conservation and urban renewal.
(4)
Growth concepts and management, plan implementation and intragovernmental coordination.
(k)
Coordinate the extension and expansion of water and sewer lines and facilities with JEA.
(l)
Coordinate and, except as would be accomplished by the Jacksonville Transportation Authority, Jacksonville Seaport Authority or the Jacksonville Airport Authority, prepare, maintain or coordinate plans for all modes of transportation, including:
(1)
The general location and character of streets, viaducts, bridges, parkways and public parking areas.
(2)
The development of a comprehensive system of arterial highways.
(3)
The development of public mass transit systems.
(4)
The location of bus, truck and railroad terminals and facilities.
(5)
The development of air fields, air terminals and related facilities necessary for the accommodation of private and commercial air traffic.
(m)
Develop plans for bikeways, walkways, scenic routes and trails, access management and transportation studies.
(n)
Prepare comprehensive plans for the development of port facilities, the improvement of natural waterways and artificial channels and the identification of dredge spoil areas.
(o)
Provide administrative and planning staff services to the Planning Commission and, pursuant to staff services agreements, to regional planning bodies affecting the City and to other governmental units.
(p)
Provide planning services to the Office of Economic Development and the Jacksonville Housing and Community Development Commission.
(q)
Review all project planning proposals of executive departments and independent agencies prior to the commencement of any work.
(r)
Prepare planning assessments pursuant to Section 122.609.
(s)
Maintain past and current data relating to population, employment, the economy, land use and other statistical areas for use by public agencies and private individuals, firms and organizations.
(t)
Be responsible for administration and implementation with respect to all agreements for which the Department has accepted responsibility, including consultants' agreements, interlocal agreements to which the City is a party, interagency agreements to provide administrative, technical or professional staff services for other governmental agencies and grant agreements.
(u)
As requested by the Council, advise the Council with regard to the decennial reapportionment plan for Council districts.
(v)
Prepare, print and distribute reports, studies and other documents in connection with its planning and review functions.
(w)
Advise governmental units and the public on planning matters within the scope of its duties.
(x)
Provide administrative and planning staff services to the Historic Preservation Commission.
(y)
Perform such other functions as may from time to time be assigned or delegated to it by law or the Mayor.
(z)
Coordinate with the Downtown Investment Authority Chief Executive Officer regarding planning, permitting and development Downtown. Such areas shall include, but not be limited to, the Historic Preservation Section, Development of Regional Impact Coordinator, and the Bicycle/Pedestrian Coordinator.
(aa)
Coordinate, develop, refine, and integrate the resilience policies and practices for the City.
(bb)
Develop and coordinate the City's Resiliency Strategy across all departments.
(cc)
Coordinate high-priority resilience projects, including securing funding for resiliency initiatives, monitoring, and reporting progress on those projects.

Sec. 30.106. - Savings provisions.
Orders, determinations, recommendations, rules and regulations which were made by the Jacksonville Area Planning Board before October 1, 1980 and which are in effect on October 1, 1980 shall continue in effect according to their terms until modified, terminated, superseded, set aside or revoked in accordance with law, by their terms or by operation of law. The Department, the Planning Commission or the Director, as appropriate, shall be substituted for the Planning Board in these orders, determinations, recommendations, rules and regulations and shall have full power in connection therewith.

Sec. 30.107. - Department as central service.
The Department is a central service of the Consolidated Government and all City departments, offices and boards and all independent agencies of the City shall utilize the services of the Department in connection with comprehensive planning. The Department shall not perform project planning and operational programming for any City or independent agency nor shall the Department conduct or perform planning (except with respect to capital improvements) for criminal justice, social or health delivery systems or programs, except in either case by interagency agreement between the Director and the City or independent agency concerned.

Sec. 30.201. - Establishment; membership.
(a)
There is established within the Department, as an autonomous component thereof, a Planning Commission (hereafter referred to as "Commission") consisting of nine members, and three alternates, appointed by the Mayor and confirmed by the Council for a term of three years. Of the nine members and three alternates, one member shall be appointed from and shall be continuously throughout his term a resident of each City Planning District, and three members and the three alternates shall be appointed at-large and shall be residents of the City during their entire terms; provided, however, that the member from the Urban Core Planning District shall be a resident of, or own a business in, that District; failure to retain these qualifications shall automatically remove the person not qualified from serving as a member or alternate. The three alternates shall either be former Planning Commission members or former City Council members who have served on the Land Use and Zoning Committee of the City Council. Members and alternates shall be appointed for three-year staggered terms (except appointments to fill vacancies). The membership of the Commission shall include, to the extent available, three persons who are educated or practice in one of the disciplines of planning, design, development or related disciplines. No member shall serve for more than two consecutive full terms; but appointments to fill vacancies for unexpired terms and initial appointments under the preceding sentence for less than three years shall not be deemed to be full terms. A member or alternate may be removed by the Mayor during his term, with the approval of the Council. A vacancy shall be filled in the same manner as the original appointment, for the unexpired term. Members shall serve without compensation, but shall be entitled to travel expense reimbursement in accordance with Part 7, Chapter 106. The provisions of F.S. § 286.012, as amended from time to time, shall apply to each member and alternate of the Commission.
(b)
Additionally, as required pursuant to F.S. § 163.3174(a), a representative of the Duval County School District appointed by the Duval County School Board shall be included as a nonvoting member of the Planning Commission to attend those meetings or portions of meetings at which the Planning Commission considers comprehensive plan amendments and rezonings that would, if approved, increase residential density on property that is the subject of an application.
(c)
Additionally, as required pursuant to F.S. § 163.3175(5), a representative of a military installation acting on behalf of all military installations within the City of Jacksonville shall be included as an ex officio, non-voting member of the Planning Commission to facilitate the exchange of information regarding proposed changes to the Comprehensive Plan or land development regulations which, if approved, would affect the intensity, density, or use of land adjacent to, or in close proximity to a military installation.

Sec. 30.202. - Organization.
(a)
The members of the Commission shall annually elect a chairman, one or more vice chairmen as provided in its rules and a secretary from among its members. The officers shall have such duties and responsibilities as are assigned to them by the rules of the Commission.
(b)
The Commission may establish such committees from among its membership as it deems necessary to carry out its functions. The Commission may also, from time to time, authorize the establishment of task forces to carry out specialized and detailed projects within the scope of its purposes; a task force may include persons who are not members of the Commission.
(c)
The Director shall furnish the Commission with all necessary administrative support, including fiscal support. The Commission shall be independent of the Department in the performance of its duties and functions.

Sec. 30.203. - Conduct of business.
The Commission shall meet at least twice each month as set forth herein (but it may waive one meeting each month by a majority vote of the members), and special meetings shall be called in accordance with its rules. The Commission shall hold regular meetings on the first and third Thursdays of each month commencing at such time and place as fixed by its bylaws, except for the first Thursday in July and the third Thursday in December, so that such Commission meetings are held on the Thursday that falls during the weeks that Council's Standing Committees meet; and except that when a regular meeting day shall fall on a legal holiday observed by the City, or on an election day, the regular meeting of the Commission shall be held on a day and at a time and place as fixed by its rules. Notwithstanding any provision in these rules to the contrary, if a regular meeting day shall fall on a date that coincides with the observances of a religious holiday, such regular meeting may be rescheduled at the direction of the Commission Chairperson. A quorum shall consist of five members or duly appointed alternates. The concurrence of the greater of four Commission members or a majority of Commission members present shall be required before any report or recommendation is made on any matter considered by the Commission, or to act upon and make a final determination regarding a request for an exception, a variance, a waiver, approval of cellular antenna reviews or minor modifications, or an appeal from the decision of the Building Official; provided, however, after one deferral due to a lack of concurrence of the greater of four members of the Commission or a majority of Commission members present, a report or recommendation to the Council, or a committee thereof, shall only require the concurrence of the greater of a majority of quorum (three members of the Commission) or a majority of Commission members present. If, by reason of absence or disqualification of a member, a quorum is not reached, the Chairperson of the Commission shall designate as many of the duly appointed alternates to serve as members on the Commission for an individual meeting or until a vacancy is filled, as may be needed to provide a quorum. When designated pursuant to the provisions of this Section, a duly appointed alternate shall be entitled to participate in all proceedings and discussions of the Commission to the same and full extent as provided by law for members, including specifically the right to cast a vote as a voting member during the proceedings, except for votes concerning the election of officers of the Commission, and shall have all the powers and duties as otherwise provided by law. Any duly appointed alternate may participate in any proceeding or discussion of the Commission but shall not be entitled to vote as a member of the Commission nor be reimbursed pursuant to Part 7, Chapter 106 unless designated as a voting alternate member by the Chairperson pursuant to this Section. A vacancy shall not impair the ability of the remaining members to execute all the duties and perform all the functions of the Commission. The Commission shall have the power to adopt, amend and repeal rules for its internal organization and the conduct of its business.

Sec. 30.204. - Functions.
The Commission shall:
(a)
Review proposed land use changes, text changes to the Comprehensive Plan, requests for exceptions (except alcohol-related exceptions which shall be heard by the City Council), variances, waivers to the Zoning Code, and rezonings (except those pertaining to properties located within the Downtown Overlay Zone, as defined in Section 656.361.2), appeals from written orders granting or denying an administrative deviation and written interpretations of the Zoning Code and final orders of the Cell Tower Review Committee and other matters related to land use and area planning which are referred to the Department or to the Commission pursuant to law. For rezonings within the Downtown Overlay that have a companion Future Land Use Map amendment, both the Commission and the Downtown Development Review Board shall review and make recommendations to the City Council and the DIA, as the case may be.
(b)
Review and make recommendations to the Council on proposed changes to the Zoning Code, the Code of Subdivision Regulations and other land development regulations or amendments thereto.
(c)
Review and make recommendations on plans and programs developed by the Department (excluding project planning) prior to transmittal to the Mayor or independent agency, as the case may be.
(d)
Serve as the local planning agency required pursuant to F.S. § 163.3174, and prepare the comprehensive plan or plan amendment after hearings to be held after public notice and make recommendations to the City Council regarding the adoption or amendment of the comprehensive plan.
(e)
Monitor and oversee the effectiveness of the status of the comprehensive plan and recommend to the Council such changes in the comprehensive plan as may from time to time be required, including the preparation of periodic reports required by F.S. § 163.3191.
(f)
Review and assign planning priorities under Part 6, Chapter 122 and perform the reviews required by Sections 122.606 and 122.609.
(g)
Review and assign planning priorities under Chapter 748 and perform the reviews required by Sections 748.202 and 122.609.
(h)
Review and make recommendations on plans prepared pursuant to state and federal requirements or regulations.
(i)
Act as a coordinating agency for programs and activities of executive agencies and independent agencies affecting land use and area planning, when requested to do so by the Mayor or the Director.
(j)
Review appeals of Written Interpretations rendered by the Director pursuant to Section 656.109, Ordinance Code, and conditions of site plan approvals imposed by the Department pursuant to Section 656.404, Ordinance Code.
(k)
Hear appeals from the owner of any off-site commercial billboard with respect to any final action taken by the Building Inspection Division concerning off-site commercial billboards that does not involve an interpretation or application of the uniform Florida Building Code. The scope of review, procedures and process for such review shall be as set forth in Section 656.135 (Appeal of written interpretation of the Director), Ordinance Code. A final order rendered by the Planning Commission concerning any such appeal shall be deemed to be the final action of the City of Jacksonville and shall not be subject to any further review under this Ordinance Code.

Sec. 30.301. - Establishment; responsibilities.
There is established within the Department a Current Planning Division, which shall be responsible for:
(a)
The preparation, evaluation and review of zoning applications, certifications, administrative deviations, variances, waivers and exceptions, and amendments and modifications thereto, as required by Chapter 656;
(b)
Preparing, maintaining and updating the zoning atlas;
(c)
Site plan reviews;
(d)
Cell tower reviews;
(e)
Staffing to the Planning Commission, Land Use and Zoning Committee of the City Council, the Cell Tower Review Committee and other committees or task forces as assigned; and
(f)
Any other duties as assigned by the Director.

Sec. 30.302. - Division Chief.
The division chief of the Current Planning Division shall be the Chief, Current Planning Division. The Current Planning Chief shall have a college degree from an accredited college or university, in urban planning, community planning, regional planning, architecture, geography or landscape architecture public administration or related field and at least seven years' experience in comprehensive community planning, or at least five years of experience with a master's degree in any of the listed fields, or commensurate training and experience, and shall have proven administrative experience. He shall be appointed by the Mayor and confirmed by the Council and shall serve at the pleasure of the Mayor.

Sec. 30.401. - Community Planning Division; Establishment; Responsibilities.
There is established within the Department a Community Planning Division, which shall be responsible for:
(a)
Preparation, evaluation and review of the comprehensive plan for the City, including the required five-year Evaluation and Appraisal Report (EAR), and amendments and modifications thereto, as required by Chapter 650;
(b)
Preparation, maintenance and updating of short and long-range plans relating to land use, community facilities, utilities and environmental systems and for compiling and updating socioeconomic data used by the Department;
(c)
Capital Improvement and facilities planning;
(d)
Land use regulation matters, including environmental and historic preservation matters related to land use;
(e)
Preparing historic studies, designations, tax abatement requests, certificates of appropriateness;
(f)
Providing staff support to the Historic Preservation Commission;
(g)
Parks Planning;
(h)
Reviewing and monitoring all Developments of Regional Impact;
(i)
Preparation and implementation, as required, of special planning studies including but not limited to Neighborhood Action Plans, District Plans, Special Study Areas, etc.;
(j)
Preparation and/or participation in planning studies such as corridor studies, district plans, and neighborhood action plans;
(k)
Any other activities as may be assigned by the Director.

Sec. 30.402. - Division Chief.
The Division Chief of the Community Planning Division shall be the Chief, Community Planning Division. The Chief of Community Planning Division shall have a bachelor's degree or higher in an accredited college or university degree in urban or regional planning, geography or civil engineering, community planning, architecture, landscape architecture, public administration or related field and at least seven years experience in comprehensive community planning or at least five years of experience with a masters degree in any of the listed fields, or commensurate training and experience, and shall have proven administrative experience. The Chief shall be appointed by the Mayor and approved by the Council and shall serve at the pleasure of the Mayor. The Chief shall serve as staff to the Context Sensitive Streets Standards Committee set forth in Section 32.702, Ordinance Code and serve as a member of the Subdivision Standards and Policy Advisory Committee.

PART 8. - TRANSPORTATION PLANNING DIVISION
Sec. 30.801. - Establishment; responsibilities.
There is established within the Department a Transportation Planning Division, which shall be responsible for:
(a)
Preparation, review and updating of all short and long term transportation plans for all modes, including congestion management plans;
(b)
Traffic and transit testing for concurrency and/or mobility and proportionate fair share assessments;
(c)
Coordination and review with Public Works of all Proportionate Fair Share Capital Improvement Projects or Mobility Projects;
(d)
Preparation of all transportation monitoring reports (i.e. F.S. Ch. 163, Agreements for proportionate fair share, development agreements, etc.);
(e)
Review of Developments of Regional Impact, Regional Activity Centers and all rezonings for transportation impacts;
(f)
Bicycle and Pedestrian Coordinator;
(g)
Coordination with FDOT and the regional metropolitan planning organization, known as the North Florida Transportation Planning Organization, on transportation issues;
(h)
Coordination with JTA on Mass Transit issues;
(i)
Developing CIP on transportation projects;
(j)
Review of site plans for transportation issues;
(k)
Review of access management issues;
(l)
Management and maintenance of the Concurrency system;
(m)
Preparation, review and tracking of all Proportionate Fair Share applications; and
(n)
Other duties as assigned by the Director.

Sec. 30.802. - Division Chief.
The Division Chief of the Transportation Planning Division shall be the Chief, Transportation Planning Division. The Transportation Planning Chief shall have a college degree from an accredited college or university, in urban planning or urban design or related field and at least ten years' experience in urban design and management experience, or at least five years of experience with a master's degree in any of the listed fields, or commensurate training and experience, and shall have proven administrative experience. The Chief shall be appointed by the Mayor and confirmed by the Council and shall serve at the pleasure of the Mayor.

Sec. 30.803. - Bicycle/Pedestrian Coordinator.
There is hereby established a full-time position of the Bicycle/Pedestrian Coordinator within the Transportation Planning Division of the Planning and Development Department. The Bicycle/Pedestrian Coordinator shall have the authority to review all plans submitted for review pursuant to Chapter 654, to serve as staff to the Context Sensitive Streets Standards Committee set forth in Section 32.702, Ordinance Code, coordinate with the Traffic Engineering Division of the Public Works Department with respect to issues pertaining to bicycle and pedestrian use of rights-of-way, coordinate with the Planning Services Division of the Planning and Development Department on the implementation and any updates of the Mobility Plan with respect to bicycle and pedestrian issues, and coordinate with the Office of the Sheriff, with respect to any criminal issues pertaining to bicycle and pedestrian safety, and coordinate with any other agency or department with respect to bicycle and pedestrian issues. The Bicycle/Pedestrian Coordinator shall have a college degree from an accredited college or university, in urban planning, community planning, regional planning, architecture, geography or landscape architecture, public administration or related field and at least five years' experience in planning, or at least four years of experience with a master's degree from an accredited college or university in any of the above listed fields. The Bicycle/Pedestrian Coordinator shall also have at least two years' experience in bicycle and pedestrian design standards. AICP certification is preferred.
