Sec. 62.101. - Board established.

There is established a Construction Trades Qualifying Board (hereinafter referred to as the Board) consisting of 18 members from the following categories who shall be appointed by the Mayor and confirmed by the Council:

(a)

One architect registered in the State;

(b)

One engineer registered in the State;

(c)

Three contractors certified by the State or holding valid certificates of competency with the Board and registered with the State, one in each of the following categories; a general, building or residential contractor; a swimming pool contractor; and a roofing contractor.

(d)

Four contractors certified by or registered with the State, or holding a local specialty contractor certificate of competency, and holding a valid journeyman or master certificate of competency with the Board, one in each of the following categories: an electrical contractor; a heating, air conditioning, refrigeration (HAR) contractor; a plumbing contractor; and an irrigation contractor;

(e)

Three journeyman craftsmen or master certificates holding valid journeyman craftsman certificates or master certificates with the Board, one in each of the following categories: an electrical contractor; a heating, air conditioning, refrigeration (HAR) contractor; and a plumbing contractor;

(f)

Two individuals associated with the apartment industry; and

(g)

Two citizens who are not associated with the construction industry.

If sufficient members from categories (c), (d), and (e) are unavailable, the appointing authority may select additional members from category (g) or from specialty contractor categories holding Certificate of Competency with this Board. Each member of the Board shall reside in Duval County. Provided, however, any nonresident member serving on the board on February 1, 1997, who is serving a second term may continue serving until the expiration of such term, and any nonresident member serving on the board on February 1, 1997, who is serving a first term may continue serving on the board for the remainder of that term and may be reappointed for one more full term.

To be eligible to serve, each trade member must have been so engaged in the trade for a period of not less than three consecutive years before the date of appointment.

Sec. 62.102. - Term of office; removal.

(a)

Members of the Board shall be appointed for a term of three years commencing on October 1, or until their successors are appointed and qualified. The terms of members from category (c) in Section 62.101 shall not run concurrently. Likewise, the terms of members from category (d) and category (e) in Section 62.101 shall not run concurrently.

(b)

The Board by majority of the quorum present may declare a position vacant for three or more unexcused absences within a year. Once declared vacant, the Board shall direct the chairman to petition the appointing authority to recommend to Council that the Board member be removed. Any member of the Board may be removed from office for cause by a two-thirds vote of the entire Council.

Sec. 62.103. - Meetings.

The Board shall hold at least four meetings each fiscal year, one each in October, January, April and July. Regular or special meetings shall be called by the chairman of the Board and in his absence by the vice-chairman of the Board or by a quorum of the Board. Special meetings shall be called only with at least 48 hours' notice to all members as to the time and place. A quorum shall consist of the greater of five members or a third of the current Board membership. Vacant board seats shall not be included in the quorum determination. An affirmative vote shall consist of a simple majority of the members present.

Sec. 62.104. - Employees.

The Board may appoint an Executive Director and such other staff as may be necessary to conduct the business of the Board. The Executive Director shall be appointed by the Board, subject to confirmation by the Council, and shall serve at the pleasure of the Board. The Executive Director's pay grade, salary range, salary and benefits shall be established and set as are appointed officials in accordance with Section 129.101(b) and (c), Ordinance Code, and the Appointed Employees and Officials Salary and Employment Plan. The Executive Director will be exempt from the classified civil service. Other Board employees will be selected from eligibility lists certified by the Human Resources Division in the appropriate job classification. The duties of the Executive Director shall be to manage and supervise the Board office and staff in carrying out the policies and directives of the Board and to ensure completion of all administrative matters. The executive director shall handle such other duties as the Board may from time to time assign. To perform its duties, the Board may call upon the Chief of Building Inspection to furnish employees as may be needed from time to time to make investigations and enforce ordinances.

Sec. 62.105. - Oaths and subpoenas.

To carry out its duties, the Board may administer oaths and subpoena witnesses.

Sec. 62.106. - Powers and duties.

The Board shall:

(a)

Administer Chapter 342.

(b)

Ensure that an applicant for any certificate meets the qualifications provided by law.

(c)

Provide for the preparation, administration and grading of examinations.

(d)

Decide questions of definition and interpretation of the scope of work of the various construction trades covered by Chapter 342.

(e)

Make recommendations to the Council for amendment to ordinances it is required to administer.

(f)

Provide a continuous study of the different trades and crafts regulated by Chapter 342 and recommend the regulation of additional trades or crafts as may be determined to protect the public health, safety and welfare.

Perform such other duties as are assigned to it from time to time.

Sec. 62.107. - Board records.

All minutes of the Board meetings and other records maintained by the Board shall be kept in the Board's office and are public records. Examination questions and answer sheets are confidential in nature and shall not be open to public inspection. An examinee shall have the right to review his own completed examination in the presence of the Board's director or a representative of the Board's testing agency, but may not remove them. All Board records shall be retained for a period in accordance with Part 2, Chapter 124.
