PART 1. - OFFICIAL COURT REPORTERS
Sec. 638.101. - Official court reporters to receive stipend or salary supplement; exception.
Pursuant to the provisions of F.S. Ch. 27, Pt. I, the official court reporters reporting in criminal proceedings in the Circuit and County Courts within Duval County shall receive a stipend or salary supplement from the City, in addition to the salaries and expenses of the official court reporters that are paid from the annual appropriations act of the Legislature. The stipend or salary supplement shall be paid to the official court reporters who are designated by the chief official court reporter, with the approval of the Chief Judge of the Fourth Judicial Circuit, to receive the stipend or salary supplement; provided, that:
(a)
A stipend or salary supplement shall be paid only to those official court reporters who are paid a salary under the annual appropriations act of the Legislature.
(b)
Stipends or salary supplements shall be paid under this Section only to the extent that funds have been appropriated and positions have been authorized by the Council in the budget ordinance or supplemental appropriations ordinances.

Sec. 638.102. - Official court reporters required to report criminal proceedings.
Each official court reporter who receives a stipend or salary supplement pursuant to this Part shall devote his entire time to the reporting of criminal proceedings in the Circuit and County Courts, and shall be designated as an official court reporter-criminal. However, when approved by the Chief Judge, an official court reporter who does not spend substantially all his time reporting criminal proceedings, but who does report such proceedings on a frequent basis, may be authorized by the chief official court reporter to be paid a stipend or salary supplement as an official court reporter-civil.

Sec. 638.103. - Deputy official court reporters.
When, in the opinion of the Chief Judge, it is necessary to secure the services of a deputy official court reporter on an annual basis, he shall authorize the engagement of a deputy official court reporter as an independent contractor of the City. The Chief Judge shall fix the duties and compensation of each deputy official court reporter so engaged, within the authorized salary range and budgetary limitations.

Sec. 638.104. - Additional funding for reporting criminal proceedings.
When, in the opinion of the Chief Judge, it is necessary that funds be provided by the City to provide competent reporters in criminal proceedings in the Circuit or County Court, as provided in F.S. Ch. 27, Pt. I, in addition to the funds that have been appropriated by the Council for such purpose, he shall certify the necessity and the estimated amount to the Mayor, who may make such amount available from existing appropriations or transmit a supplemental appropriation request to the Council for this purpose.

PART 2. - PUBLIC COURT REPORTERS
Sec. 638.201. - Contractual public court reporters.
No permanent full-time public court reporters shall be employed by the City, except the chief public court reporter authorized by this Section. The Mayor is authorized to engage public court reporters as independent contractors, and not as contractual employees of the City, either on an annual basis or on an occasional or intermittent basis when and as they are needed for public purposes by the Council or its committees or by an executive agency; provided, that the Mayor is authorized to employ one public court reporter as a contractual employee of the City, who shall be the chief public court reporter for the City and who shall be responsible for coordinating and supervising the public court reporters who are engaged as independent contractors, for assigning and reassigning the reporters as necessary and for recommending to the Mayor the hire or termination of reporters as required for the official business of the City. Except for the chief public court reporter, the salaries and fees for the public court reporters shall be paid from the appropriations for other services and charges. The chief public court reporter employed by the Mayor and the public court reporters engaged under this Section shall be chosen from those court reporters who are listed on the list prepared under Section 126.308.

Sec. 638.202. - Duties of public court reporters.
Each public court reporter engaged by the City under Section 638.201 shall report the testimony and proceedings, including objections made or oral comments offered, of any meeting, session or public hearing of the City agency to which the reporter is assigned by the chief public court reporter. Upon the order of the City agency or upon the demand of any person who participated in the meeting, session or public hearing, the reporter shall furnish with reasonable diligence a typewritten transcript of the testimony and proceedings and shall receive therefor the fees specified in subsection 638.204(b). When the transcript is ordered by the City agency, the fees shall be paid by that agency; and when the transcript is prepared at the demand of any other person, the fees shall be paid by that person.

Sec. 638.205. - Other employment not prohibited.
Unless prohibited by the contract between the City and the chief public court reporter or public court reporter, the reporter shall not be prohibited from reporting in any of the courts of the state or the United States or from reporting proceedings and matters for private persons, and he may be compensated therefor without regard to any compensation to which he may be entitled under this Chapter. The chief public court reporter and each public court reporter engaged under an annual contract with the City shall not accept other employment which will interfere with the performance of his official duties for the City.
