Sec. 651.101. - Legislative findings.
The Council finds and determines that:
(a)
The City is experiencing continuous and increasing competition from other communities for attracting new jobs and retaining existing jobs within the City.
(b)
The City must provide assistance, direction, and facilitation as an incentive to businesses which create, provide or retain jobs within the City.
(c)
The number of jobs created, provided or retained within the City strengthens as well as diversifies our local economy.
(d)
The expedited permit process does not modify, qualify or otherwise alter existing nonprocedural standards for permit approval.
(e)
The expedited permit process would provide for an early identification of required permits and quicker, less costly, and more predictable permit approvals.

Sec. 651.102. - Short title.
This Chapter shall be known and may be cited as the Expedited Permitting.

Sec. 651.103. - Legislative intent.
It is the intent of the Council in enacting this Chapter:
(a)
To prescribe a process by which that significant economic development projects would be expeditiously reviewed and inspected by the various permit reviewing and inspection agencies of the City.
(b)
To establish a process by which significant economic development projects would be provided assistance, direction, and facilitation prior to, during and subsequent to the permitting and inspection process.

Sec. 651.104. - Administration.
Due to the number of different agencies of the City responsible for issuing or participating in the issuance of permits, no one agency of the Consolidated Government is assigned the sole administrative responsibility for administering this Chapter. Nevertheless, this Chapter imposes specific duties and responsibilities upon agencies which perform particular functions in the review or issuance of permits in the City including associated inspections of the same. These duties and responsibilities shall be performed and carried out in conformity with the legislative intent expressed in Section 651.103. It shall be the responsibility of the Office of Economic Development to coordinate and implement the provisions of this Chapter and may include assistance, direction and facilitation of development permits of significant economic development projects with regional, State and federal agencies.

Sec. 651.105. - Criteria/certification.
Significant economic development projects shall be those projects certified by the Executive Director of the Office of Economic Development which shall create, provide or retain at least 100 jobs; create, provide or retain at least 50 jobs in the Jacksonville Enterprise Zone, Identification No. EZ1601; create, provide or retain at least ten jobs as determined by the Executive Director to be a significant economic development project due to the proposed wage and skill levels relative to those existing in the area in which the project may be located, the project's potential to diversify and strengthen the area's economy, and the amount of capital investment; or create, provide or retain at least ten jobs associated with the redevelopment of a brownfield site or brownfield area designated pursuant to the provisions of F.S. §§ 376.77—376.85, projects certified by the Governor through the Office of Tourism, Trade and Economic Development pursuant to the provisions of F.S. § 403.973, Expedited permitting, shall be determined to meet the provisions of this Chapter without further action by the Executive Director thereof. Jobs shall be defined as full-time equivalent positions not including construction jobs.

Sec. 651.106. - Point(s) of contact.
Within 30 days of the effective date of this Chapter, the Fire and Rescue Department, Planning and Development Department, Public Works Department, Environmental and Compliance Department, and JEA shall appoint a point of contact within each respective agency who will be responsible for providing assistance, coordination, and facilitation within the agency. In the case of a multi-discipline agency responsible for more than one type of permit or inspection, a point of contact may be appointed for each discipline. Upon appointment, the Executive Director of the Office of Economic Development shall be notified of the point(s) of contact and upon any change of the same for the agency.

Sec. 651.107. - Permit and inspection expedited.
Upon submission of complete plans and drawings meeting minimum City standards for review, the plans shall be expeditiously reviewed by each agency of the City. The expedited review process shall not modify, qualify or otherwise alter agency nonprocedural standards for permit approval unless expressly authorized by law. In addition, the expedited permit review process shall not assure or guarantee approval of any permit. Required inspections by the agency shall also be expeditiously conducted during the development and construction phase of the project so as not to detrimentally affect the development and construction of the same.

Sec. 651.108. - Ineligible projects.
The following projects shall be ineligible for review under this Chapter:
(a)
A project funded and operated by any local government, as defined in F.S. § 377.709.
(b)
A project, the primary purpose of which is to:
1.
Effect the final disposal of solid waste, biomedical waste, or hazardous waste in the City.
2.
Produce electrical power, unless the production of electricity is incidental and not the primary function of the project.
3.
Extract natural resources.
4.
Produce oil.
5.
Construct, maintain or operate an oil, petroleum, natural gas, potable water or sewage pipeline.
