Sec. 660.101. - Library established.

The proper administration of justice in Duval County requires the establishment and maintenance of an adequate central law library for the use of the judges, officers of the court, City officials and members of the general public. There is established a law library, to be known as the Duval County Law Library, which shall be located in the Duval County Courthouse.

Sec. 660.102. - Lawful general County purpose; territorial application.

The establishment and maintenance of the Duval County Law Library is a public need and is declared to be a lawful general County purpose. This Chapter shall apply throughout the General Services District.

Sec. 660.103. - Law Library Board.

There is created a Duval County Law Library Board (hereinafter referred to as the Law Library Board), composed of all the circuit judges of the Fourth Judicial Circuit. The terms of the members of the Board shall be coterminous with their terms as circuit judges, and the Chief Judge of the Fourth Judicial Circuit shall be the chairman of the Board.

Sec. 660.104. - Authority of Law Library Board.

The Law Library Board shall have control of and authority over all funds, property, gifts, legacies or devises now or hereafter owned by, acquired by or granted to the Duval County Law Library. The Board shall have full authority to make rules and regulations concerning the administration, use and operation of the Law Library and to designate the books and equipment to be acquired therefor, subject to the Purchasing Code. The Law Library shall use, on a cost-accounted basis, the central services of the City and shall pay therefor. The Law Library is a part of the judicial branch of the Consolidated Government, and shall not be subject to the Board of Library Trustees nor a part of the library system administered by the trustees.

Sec. 660.105. - Law Librarian; assistant law librarians.

The Law Library Board shall employ and discharge such persons as may be necessary to operate the Duval County Law Library, including a Law Librarian and one or more Assistant Law Librarians.

Sec. 660.106. - Board of Advisors.

(a)

The Law Library Board is authorized to create and establish a Board of Advisors for the Law Library, composed of not less than three nor more than five members of The Florida Bar having their principal practice in Duval County. The members of the Board of Advisors shall be appointed by the Law Library Board, to serve for two years or until their successors are appointed. A member of the Board of Advisors may be reappointed for successive terms.

The Board of Advisors shall generally serve in an advisory capacity to the Law Library Board and shall make recommendations to the Law Library Board concerning the use and operation of the Law Library, the books to be acquired therefor and the employment of qualified personnel. In addition, the Law Library Board may from time to time delegate any part, or all, of its authority under this Chapter to the Board of Advisors, subject to the supervision, control and direction of the Law Library Board.

Sec. 660.107. - Trust fund established.

There is established a trust fund, to be known as the Duval County Law Library Trust Fund, into which shall be placed all revenues and receipts for the Law Library and from which shall be paid the expenses of the Law Library, including central services charges. All expenditures, except central services charges, shall be authorized by the Law Library Board before disbursement. Any and all sums remaining in the trust fund at the end of a fiscal year shall remain in the trust fund until expended pursuant to the provisions of this Chapter.

Sec. 660.108. - Annual budget required.

The Law Library Board shall annually submit a proposed budget for the operation and administration of the Law Library through the Office of the Court Administrator to the City, in the form and at the time established by the City for the submission of budget proposals. The estimated revenues of the Law Library shall include the receipts from the additional service charge and filing fees authorized by Section 630.103, any carryover funds from previous fiscal years and an appropriation of general revenues sufficient to fund completely the otherwise unfunded operations of the Law Library. No specific or fixed appropriation of general revenue funds is made or required.

Sec. 660.109. - Law Librarian may instruct certain courses.

Notwithstanding the provisions of Section 116.106, the Law Librarian may, with the approval of the chairman of the Law Library Board, instruct courses or classes in legal research or legal writing in the Duval County Law Library for an accredited institution of higher learning, for which the Law Librarian may receive compensation from the institution.
