Sec. 662.101. - Free public library system established.

There is established in the City a free public library system for the use and enjoyment of the residents of the City. The library system shall be administered by the Board of Library Trustees (hereinafter referred to as the Board) created by Chapter 90. The library system shall be composed of the books, documents, pictures, audio and video tapes, compact discs, periodicals, manuscripts, and other informational formats as well as the various library services offered by the Board from time to time.

Sec. 662.102. - Library facilities.

(a)

The Board shall maintain, under rules to be prescribed by it, in the various buildings constructed or acquired for the use of the library system, a circulating library and a reference library, with suitable rooms for reading and study, and one or more free public reading rooms, where newspapers, magazines and periodicals shall be kept for public use during the hours prescribed by the Board. The Board is authorized to establish, operate, change the operation of and disestablish a mobile library service, whereby areas of the City not served by a library within reasonable distance can take advantage of the free library system.

(b)

Notwithstanding any contrary provisions of Section 122.102, Ordinance Code, the Jacksonville Board of Library Trustees (the Board) is authorized to select names and to name various libraries, except the main library which shall be designated "The Jacksonville Public Library" and shall not bear the name of any individual. The Board is also authorized to select names for any appurtenances such as rooms, collections of books, lobbies, etc. to any library, including The Jacksonville Public Library, in honor and recognition of any person, living or dead, corporation, association or other entity.

Sec. 662.103. - Registration and circulation records confidential.

All registration and circulation records of every public library, except statistical reports of registration and circulation, are confidential and exempt from the provisions of F.S. § 119.07(1) and from Fla. Const. Art. I, § 24(a). Except in accordance with proper judicial order, a person may not make known in any manner any information contained in such records, except as provided in this Section. As used in this Section, the term "registration records" includes any information that a library requires a patron to provide in order to become eligible to borrow books and other materials, and the term "circulation records" includes all information that identifies the patrons who borrow particular books and other materials. This Section does not prohibit any library, or any business operating jointly with the library, from disclosing information to municipal or County law enforcement officials, or to judicial officials, for the purpose of recovering overdue books, documents, films, or other items or materials owned or otherwise belonging to the library. This Section does not prohibit any library, or any business operating jointly with the library, from disclosing information to municipal or County law enforcement officials or to judicial officials or to any business for the purpose of collecting fines or overdue books, documents, films, or other items or materials. In the case of a public library patron under the age of 16, a public library may only release confidential information relating to the parent or guardian of the person under 16.

Sec. 662.104. - Fees authorized in certain instances.

The Board may charge and collect fees from residents of the City in the following circumstances:

(a)

For special services performed at the specific request of the patron, other than the usual circulation of books and other library materials.

(b)

For the inconvenience and disruption of services caused by the late return of library books and materials.

(c)

To replace books and other library materials which have been taken by a patron and not returned within the time prescribed by the Board or upon demand of the Board or an authorized employee.

Sec. 662.105. - Non-residents authorized library privileges.

The Board is authorized and empowered to extend borrowing privileges and the use of books and materials of the library system to persons who are not residents of the City, by either or any combination of the following methods:

(a)

The Board may charge users a fee equal to the cost of the service and, in this event, shall set terms and conditions by formal resolution of the Board which will insure that the cost of library service to nonresidents, as determined by the Board, shall be defrayed by nonresident borrowers and shall not be borne by the City. The Board may set library fees in amounts and for various classifications of users and may demand security deposits as the Board finds necessary to secure the library system against damage by the loss or damage of borrowed materials.

(b)

The Board may contract with the Board of County Commissioners of any adjoining County for free library service to the citizens thereof, upon such terms as the Board deems adequate to cover the cost to the City of the library services agreed to be furnished.

(c)

Persons who are the recorded owners of real property in Duval County on which they pay ad valorem taxes are hereby classified as resident citizens in so far as use of the City's free library system is concerned.

Sec. 662.106. - Failure to return library materials.

(a)

It shall be unlawful for any person to fail to return any book or other library material after 30 days' notice in writing to return the material, given after the expiration of the time for which, by the rules of the Board, the book or other library material may be kept.

(b)

Any person who violates this Section shall be punished by a fine of not less than $10 nor more than $50 or by imprisonment of not more than 30 days, or by both a fine and imprisonment.
