Sec. 663.101. - Concession contractor defined.

As used in this Chapter, the term concession contractor means a person contracting with the City for the sale of food, drink, souvenirs, novelties or similar articles on the premises of, or at events sponsored by, the City.

Sec. 663.102. - Required concession contract terms.

Every contract between the City and a concession contractor shall include the following terms:

(a)

There shall be conducted at the expense of the concession contractor a weekly physical inventory of all salable and non-salable merchandise to be offered to the public by the concession contractor, following which there shall be prepared and submitted to the City a full and complete accounting of the results of the operations of the concession contractor for the preceding week. The inventory, accounting and related records shall be available to the City during the term of any concession contract and for a period of two years after the expiration thereof.

The concession contractor shall maintain perpetual inventory records, which shall be available to the City during the term of any concession contract and for a period of two years after the expiration thereof.

Sec. 663.103. - Furnishing of invoices.

The concession contractor shall furnish to the City invoices or reliable copies thereof of all purchases made by him under any contract with the City.

Sec. 663.104. - Certification of documents.

The concession contractor or his authorized agent shall certify under oath as to the completeness and accuracy of the inventories, accounting statements and purchase invoices furnished the City, and of the total gross revenues, and as to the truth of the facts presented thereby.

Sec. 663.105. - Posting of bonds.

The concession contractor shall post with the City a reasonable bond or bonds conditioned upon the faithful performance of their duties by all employees of the concession contractor who handle or supervise cash or other evidence of revenue.

Sec. 663.106. - Maintenance of accounting records.

Every concession contractor shall keep adequate records of all transactions under concession contracts with the City and shall make these records available to the City at any time during the life of the concession contract to which they relate, and for a period of two years thereafter.

Sec. 663.107. - Disposition of certain receipts by concession contractor.

The concession contractor is authorized and shall make all payments collected and due the City under the concession agreement from the concession contractor's operations at the Jack Drew Softball Complex to Jax Metro, Inc., to defray expenses of various annual softball tournaments held within this time period, subject to the approval of the Director of Recreation and Parks. All moneys received by Jax Metro, Inc., from the concession contractor and not used to defray expenses of the above-referenced tournaments shall be paid to the City, together with a written statement delivered to the Director of Finance and Administration showing the amount of the sums received from the concession contractor and the disposition thereof.
