Sec. 82.101. - Jacksonville-Duval County Council on Elder Affairs established.
There is hereby established the Jacksonville-Duval County Council on Elder Affairs (hereinafter known as the Council on Elder Affairs "COEA"). In establishing the Council on Elder Affairs, the City is exercising its authority as a county to create a Countywide body representative of all of the elderly people of Duval County. The Council on Elder Affairs shall be composed of 19 members appointed as hereinafter provided. All members of the Council on Elder Affairs shall serve for a term of two years or until their qualified successors are appointed. Members may be reappointed; provided however, any member who has been appointed for two consecutive full terms shall not be eligible for all or any part of the next succeeding term, regardless of whoever makes the appointment. Any member who has been appointed for two consecutive full terms may be appointed to serve again, after passage of at least one full two year term. An appointment to fill a vacancy in an unexpired term shall not be considered as an appointment to a full term. Fourteen members of the Council on Elder Affairs shall be appointed by the City Council (one nominee from each of the 14 District Council Members) and five at large members of the Council on Elder Affairs shall be appointed by the Mayor and confirmed by the City Council. All members or reappointees (except members appointed to fill vacancies for unexpired terms) shall serve for two-year staggered terms.

Sec. 82.102. - Composition of membership; officers.
(a)
The Council on Elder Affairs shall be composed of members appointed as set forth in Section 82.101, provided, the following guidelines should be considered in making such appointments to assure that the Council on Elder Affairs will contain a broad, informed and representative mixture of persons to adequately represent the interest and concerns of this County's elderly citizens:
(1)
All members shall be age 55 or older.
(2)
Members, except those who are unpaid volunteers, should not be providers of services or employees of the local, state or federal government.
(3)
Members, except those who are unpaid volunteers, should not be officers or employees of any entity which receives public funding for projects related to or concerning the elderly. The elderly, for the purpose of this Section, is defined as a person over the age of 60.
(4)
The membership of the council should be representative of the City's diverse elderly population. At least three of the members should represent low-income, elderly minority persons in the County.
(5)
Members should represent a cross-section of the community, including retired persons, senior citizen organizations, religious organizations and actively employed senior citizens.
(b)
The Council on Elder Affairs shall select among its membership annually a chair and a vice chair. The vice chair shall act in the absence of the chair.

Sec. 82.103. - Officers; Executive Director; administrative support.
(a)
The chair shall preside at all meetings of the Council on Elder Affairs and shall appoint the members of the various committees and task forces established by the Council on Elder Affairs. In the event of a vacancy in the position of Executive Director as provided in Section 82.103(c), Ordinance Code, the chair shall exercise the duties and functions of the Executive Director.
(b)
The Council on Elder Affairs shall have an Executive Director, who shall be appointed by the Mayor. The position may be funded by federal, state, charitable foundation or other grants, and City resources as may be received and appropriated by the City Council. The Executive Director shall perform those duties as outlined in the job description and delegated and assigned by the Council on Elder Affairs.
(c)
The Executive Director position shall be selected from candidates' applications according to the Employee Services Directive 0123 for Appointed Official Recruiting and Hiring Process.

Sec. 82.104. - Meetings; committees; task forces; voting and quorum.
(a)
The Council on Elder Affairs shall meet at such times and places as shall be fixed by the rules of the Council on Elder Affairs and in accordance with Section 15.104 (Public Meetings location), Ordinance Code, and special meetings shall be called in accordance with the rules of the Council on Elder Affairs. Meetings will be conducted in such places as will assure open, reasonable, and convenient access to the public.
(b)
The Council on Elder Affairs may from time to time establish such committees and task forces as it deems necessary to carry out its functions including the preparation of reports and the handling of specialized projects. The Council on Elder Affairs has authority and discretion to initiate and modify any such request for a report or specialized project. A committee or task force may include persons who are not members of the Council on Elder Affairs. A committee and task force shall use the services and staff of the Council on Elder Affairs (except such services and staff as may be provided voluntarily and without cost to the City by other agencies and organizations). Committees and task forces shall report and make recommendations only to the Council on Elder Affairs at such times as the Council on Elder Affairs shall direct. The Council on Elder Affairs may take such action on such reports and recommendations as it deems advisable within its authority.
(c)
The Council on Elder Affairs' decisions and recommendations shall require a concurring vote of a majority of the members voting. A majority of the current membership of the Council on Elder Affairs, excluding vacant seats, shall constitute a quorum for the purpose of meetings and transacting business. A vacancy shall not impair the ability of a majority of the remaining members to execute all the duties and perform all the functions of the Council on Elder Affairs.

Sec. 82.105. - Purposes.
The Council on Elder Affairs is established for the following general purposes:
(a)
To serve as an advocate for the elderly in the City, to the governmental agencies responsible for the various plans and programs designed to help the elderly.
(b)
To assist in the implementation of plans and programs selected by regional organizations, as they relate to the City and its elderly.
(c)
To designate priorities among programs developed in the City by public, nonprofit and private providers concerning the elderly.

Sec. 82.106. - Duties.
In implementing its purposes under this Chapter, the Council on Elder Affairs shall have the following duties:
(a)
To attend public hearings, forums, town hall meetings, to receive information, and disseminate from all segments of the community with respect to the effectiveness of existing services and the need for additional or different services to meet adequately the needs of the elderly.
(b)
To evaluate current services and programs in terms of the objectives and purposes established for them in meeting the needs of the elderly.
(c)
To determine services needed by older persons that are not currently being provided by public or private providers.
(d)
To develop and recommend priorities:
(1)
For services provided by the City,
(2)
For services provided by agencies and organizations other than the City, and
(3)
For new services that may be recommended.
(e)
To recommend methods of eliminating duplications of new or proposed services and established services.
(f)
To recommend coordination of existing services and all new services designed to augment or replace existing services, to obtain maximum economy, efficiency and effectiveness of all services for the elderly.
(g)
To provide persons to represent the City on regional organizations concerned with the problems and needs of the elderly.
(h)
To adopt, promulgate, amend and rescind rules and regulations to implement the provisions of this Chapter.
(i)
To submit an annual report to the Mayor and the Council of its activities and of the problems and progress in meeting the needs of the elderly.
(j)
To carry out such other functions as may be assigned to it from time to time by ordinance.

Sec. 82.107. - Representation on regional organizations.
The chair of the Council on Elder Affairs, with the approval of the Mayor, shall appoint if needed, representatives from among the members of the Council on Elder Affairs to serve as representatives of the City, on boards, councils, commissions or any other regional organization on which the City is to be represented, that concerns itself with the problems and needs of the elderly. A member of the Council on Elder Affairs may be appointed as a representative on more than one such regional organization, but the chair and the Mayor shall confer as to the advisability of and need for representation on each such regional organization.

Sec. 82.108. - Cooperation of other City agencies.
The services of all other departments, boards and agencies of the City may be made available to the Council on Elder Affairs at its request, subject to their ability and capacity to provide the same. The Council on Elder Affairs shall be concerned about the coordination of City activities relating to the elderly, and other City agencies shall cooperate with the Council on Elder Affairs in the exercise of this responsibility.
