Sec. 90.101. - Establishment; Composition; Member Qualifications; Terms; Annual Training Requirement; Responsibilities.

There is hereby established a board to be known as the Board of Library Trustees (the "Board") to provide free library service for the use and enjoyment of the citizens of the Consolidated Government.

(a)

Composition. The Board shall consist of 12 members, 2 members shall be appointed from (reside in) each of the five City Council At-Large Groups, and two members shall be appointed At-Large. At least 11 of the 12 voting members shall be citizens and residents of the County, and one At-Large voting member may be a non-resident provided that said member works in the City and is a patron of the Library. All members shall be appointed by the Mayor and subject to confirmation by the City Council.

(b)

Terms. Members shall be appointed for staggered four-year terms expiring September 30, but shall serve until their successor is appointed and confirmed by City Council. No member shall serve for more than two consecutive full terms.

(c)

Liaisons. Liaisons are a non-voting position and shall not be considered a member of the Board for sunshine purposes and are as follows:

The President of the City Council or his/her designee, who shall be a member of the City Council.

2.

The Superintendent of Schools or his/her designee.

3.

At the discretion of the President of the City Council, a second member of the City Council may serve as a third liaison.

Sec. 90.102. - Authority of Board.

(a)

The Board shall have the authority to receive, accept, and exercise control over funds, property, gifts, legacies and devises now or hereafter granted to the library or its predecessor libraries and agencies for the purpose of establishing and maintaining a free public library in and for the Consolidated Government and its citizens. The Board shall be responsible for the administration of Chapter 662 and the provision of the library services provided for in that Chapter.

(b)

In connection with monies drawn from the City's General Fund in each budget year, the Board shall abide by the provisions of the City's Budget and Accounting Code, the Mayor's Executive Orders relating to the Mayor's Budget Committee Review Procedures and the Administration of Non-Departmental Lapse, and any other Executive Orders pertaining to budgetary matters and the City's budgetary policies as published from time to time. The Board shall ensure that no expenditure of budgeted funds from the General Fund shall exceed maximum permissible expenditure by object account within an activity except as allowed by the City's published budgetary policies.

(c)

The Board shall have authority to approve and execute through the Library Director or designee, for and on behalf of the City of Jacksonville, memoranda of understanding ("MOUs"), and amendments thereto, with the Library's Affinity Groups (friends of the Library organizations and foundations established to support the Library's programs and services), not-for-profit organizations, government agencies, and other libraries for the purposes of enhancing, expanding, and improving library services or providing training or professional development. The MOUs are authorized however such MOUs (i) do not require additional funding from the City, (ii) do not require the City to indemnify or hold harmless a third party beyond existing statutory and common law obligations, (iii) provide for termination at will upon 90-day notice clauses, (iv) contain, near the signature block, reference to new subsection (c) as the authority for the Board to make and execute same, (v) are reviewed and approved by City of Jacksonville Risk Management Division in advance of execution, (vi) are reviewed and approved as to form by the Office of General Counsel, and (vii) are maintained by the Office of General Counsel in the form of a fully signed and executed copy or duplicate original thereof. The Director shall provide Council with a quarterly report regarding the MOUs permitted under this Section.

Sec. 90.103. - Chief librarian; employees.

The Board shall employ and discharge a chief librarian (who may be designated the Library Director) and such other persons as may be necessary to conduct a free library service. The person employed by them as chief librarian shall have a master's degree from an accredited college or university, in library science and at least five years' experience in library administration.

Sec. 90.104. - Reports.

The Board shall submit annually to the Mayor and the Council, and to the Mayor upon his request, such reports as the Mayor and Council may require concerning the activity of the Board and of the library system. The Board shall submit to the Mayor and the Council any final professional plan concerning the library capacity, including the report that is the subject of "P-26-10 Jacksonville Public Library Capacity Plan," which plan is expected to be completed by March 2011. In connection with any library capacity study or plan, the Board shall provide the Mayor and the Council with recommendations for action by the legislative and executive branches of government within 60 days after the Board's receipt of the study or plan.

Sec. 90.105. - Library-related grants.

(a)

The Board, on behalf of the Jacksonville public library system, is authorized to execute and file applications for federal and state grants for the programs listed below, in the general form of applications and agreements on file in the Office of the Council Secretary, to consummate final grant agreements within the scope of the programs applied for and to execute such documents to take such other action as may be necessary to implement and complete the programs; provided, that the provisions for review and comment by the Mayor, as required by Section 117.109, shall be adhered to:

(1)

Florida State Plan for Inter-library Cooperation;

(2)

Library Resources Center Agreement;

(3)

Intern Program Grant;

(4)

Computer and Literacy;

(5)

Library Salary Grant Agreement;

(6)

State Aid to Libraries;

(7)

Talking Book Library for the Blind;

(8)

Any other similar grants for services and facilities.

In all such cases, the Board shall file a copy of each executed agreement with the Council Auditor within 24 hours of the execution thereof by the Board.

(b)

Within the Special Revenue Funds, the funds received from state and federal sources under the grants and programs listed in subsection (a) of this Section are appropriated for their respective uses and purposes, more particularly described in the grants and agreements therefor, according to the terms thereof.

(c)

Within the Special Revenue Funds, the number of full-time employees authorized to be employed at any one time by the City under the grants and programs listed in subsection (a) of this Section shall be and is hereby increased in a number equal to the number to be employed under the respective grants and programs, and shall be available only for the respective grants and programs.
