Sec. 95.101. - Establishment.

There is hereby established a commission to be known as the Jacksonville Waterways Commission (hereinafter known as the Commission).

Sec. 95.102. - Intent of Council.

It is the intent of the Council that the Commission work in cooperation with the St. Johns River Water Management District, the State Department of Environmental Protection, the State Department of Health, the State Fish and Wildlife Conservation Commission, the United States Fish and Wildlife Service and the United States Geological Survey with regard to the performance of its duties.

Sec. 95.103. - Membership; terms; composition.

The Commission shall be composed of 13 members as follows:

(a)

Three members of the City Council appointed by the Council President plus one member of the City Council to be designated as an alternate member and to act as an alternate in the absence of one of the appointed members.

(b)

One member of the Duval County Legislative Delegation as designated by the Chairman of the Delegation.

(c)

Nine members of the general public as appointed by the City Council. Commission members from the general public shall serve for three-year staggered terms or until their successors shall have been appointed by the City Council. Notwithstanding the provisions of Section 50.104, Ordinance Code, members from the general public may serve for up to three consecutive full terms. After serving three consecutive full terms, no member may be eligible for appointment for the next succeeding term.

(d)

The Council President shall request that one member of the Planning Commission and one member of the Environmental Protection Board attend the Commission meetings and participate and advise the Commission as recognized by the Chair. The Council President shall also request that representatives of the Florida Fish and Wildlife Conservation Commission, United States Coast Guard, the Army Corps of Engineers, Florida Department of Environmental Protection, the St. Johns River Water Management District, Jacksonville Sheriff's Office Marine Unit, Jacksonville Fire and Rescue Department Marine Unit, and other entities deemed helpful to the Commission to attend scheduled meetings to act as liaisons with these entities and to provide information or occasional updates to the Commission. These representatives shall not be considered members of the Commission for Florida Sunshine purposes.

(e)

The Council President shall annually designate a City Council member to act as chairman of the Commission and a member of the commission to act as vice-chairman of the Commission.

Sec. 95.104. - Organization.

(a)

The chairman shall preside at all meetings of the Commission and shall appoint the members of the various committees, task forces, study groups and other bodies authorized by the Commission in furtherance of its purposes. The secretary shall keep the records of the Commission and the minutes of its meetings.

(b)

The Commission shall meet at such times and places as are fixed by the rules of the Commission, but at least once monthly. Special meetings shall be called by the chairman in accordance with the rules of the Commission.

(c)

The Commission shall adopt, amend and rescind rules to implement the provisions of this Chapter; but such rules shall not be effective unless and until approved by the Council. All reports, studies and recommendations made by or at the direction of the Commission shall be considered by the Commission before the same are released or laid before the Council.

(d)

The Commission may establish such committees from among its membership as it deems necessary to carry out its functions. The Commission may also, from time to time, authorize the establishment of task forces, study groups and similar bodies to carry out specialized and detailed projects within the scope of its purposes. Any such body may include persons who are not members of the Commission, but the chairman thereof shall be a commissioner. The body shall report on its progress to the Commission at such times as the Commission shall require and no report, study or recommendation, favorable or adverse, may be made by any such body unless the matter is considered by the Commission.

Sec. 95.105. - Purposes.

The Commission is established for the following general purposes:

(a)

To study and make recommendations to the Council with respect to the improvement, development and protection of the St. Johns River, all tidal waters, and all saltwater, estuarine and riverine wetlands (Class I and Class II as defined in the 2030 Comprehensive Plan) in Duval County;

(b)

To formulate an overall plan for dealing with any problems that exist concerning the St. Johns River and all tidal waters in Duval County.

(c)

To devise methods of developing future uses of the St. Johns River and all tidal waters in Duval County.

(d)

To serve as the Duval County committee to review rules proposed by the Florida Fish and Wildlife Conservation Commission governing the speed and operation of motorboats to protect manatees, as provided by F.S. § 370.12(2)(f)(3).

(e)

To assist the City in achievement of its stated goal to improve the water quality of the City's wetlands resources over the long term and improve the water quality and fish and wildlife value of wetlands by reviewing and making recommendations to the Council with respect to proposed land use amendments.

Sec. 95.106. - Duties.

In implementing its purposes under this Chapter, the Commission shall have the following duties:

(a)

To conduct research studies, collect and analyze data and prepare maps, charts and tables for the accomplishment of its purposes.

(b)

To publicize and advertise its purposes, objectives and findings and distribute reports thereon.

(c)

To advise governmental units and the public concerning the improvement, development and protection of the St. Johns River and all tidal waters in Duval County.

(d)

To act as a coordinating agency for programs and activities affecting the improvement, development and protection of the St. Johns River and all tidal waters in Duval County.

(e)

To cooperate with the Planning and Development Department in the accomplishment of its purpose, act as a specialized adviser on the St. Johns River, all tidal waters and all saltwater, estuarine and riverine wetlands (Class I and Class II as defined in the 2030 Comprehensive Plan) in Duval County to the Planning and Development Department and provide such assistance to the Department as it may require when the Department has under consideration any plans or projects concerning the improvement, development and protection of the St. Johns River, all tidal waters, and all saltwater, estuarine and riverine wetlands (Class I and Class II) in Duval County, including recommendations on land use changes. Proposed land use amendments consisting of property less than one acre or which would yield less than five total residential units or less than 10,000 square feet of commercial, office or industrial uses total shall be considered de minimis and shall not be considered by the Commission.

(f)

To submit an annual report to the Council of its activities and of the problems and progress in the improvement, development and protection of the St. Johns River and all tidal waters in Duval County, and such interim reports as it deems necessary or as the Council requires.
