Sec. 111.105. - Special Event and Parks, Recreation and Community Services Trust Funds.

(a) Special Events Trust Fund. There is created an account to be known as the Special Events Trust Fund, into which shall be deposited all funds appropriated from time to time by the Council and all event-related monies (which shall include, but not be limited to, ticket sales, donations, gifts, sponsorship underwriting fees and event participation fees which are sold by the City or given to the City from nongovernmental sources), together with the interest thereon, to assist in defraying the operational and production costs and expenses of City-sponsored or City-cosponsored special events, as such special events are determined by the Mayor or City Council. The Director of Parks, Recreation and Community Services, and the Director of Finance and Administration is authorized and directed to make disbursements from this fund upon the written requisition of the Mayor, or his or her designee, and the Mayor, or his or her designee is authorized to negotiate and execute contracts and agreements with entertainers, promoters, co-sponsors and other public or private parties or entities which are necessary both to outline and define the duties and responsibilities of the City and such other persons or entities and to assure successful special events; provided, however, that the Director of Finance and Administration shall certify on such contracts or agreements that there are current funds available in this trust fund or in the current appropriation to the Sports and Entertainment Division for special events to fund the particular special event in question, and provided further that an assistant general counsel in the Office of General Counsel shall approve such contracts and agreements as to form. No operating funds may be transferred into this trust fund unless specifically approved by City Council. All event-related monies and interest placed into this trust fund are hereby appropriated for the purposes of this trust fund and such appropriations (event-related monies and City-provided funding) shall not lapse at the close of any fiscal year, but instead shall carry over to the next fiscal year. The Sports and Entertainment Division, no later than 60 days after the last day of an event, shall deliver to the Director of Finance and Administration and the Council Auditor a complete accounting of revenues by source, and expenditures by category and source including but not limited to General Fund, Trust Fund, and any other funds, on a form agreed to by the Sports and Entertainment Chief, the Director of Finance and Administration, and the Council Auditor. (b) Parks, Recreation and Community Services Trust Fund. There is created an account to be known as the Parks, Recreation and Community Services Trust Fund, into which shall be deposited all funds appropriated from time to time by the Council and all donations, gifts, and fees which are charged by the City or given to the City from nongovernmental sources, together with the interest thereon, to enhance parks. Park enhancements can be for: (i) operating purposes such as providing higher than normal levels of service (e.g., more frequent grass mowing or enhanced programming); or (ii) capital and other improvements (including the subsequent maintenance thereof if installation is funded pursuant to this paragraph). No funding deposited and appropriated pursuant to this Trust Fund or in-kind services donation may be used for the demolition, alteration, relocation, or removal of any portion of a statue, obelisk, or monument in a park, unless approved by Council in advance of such work being performed. The Director of Finance and Administration is authorized and directed to make disbursements from this fund upon the written requisition of the Director of the Parks, Recreation and Community Services Department, or his designee (the "Director"). The Director is authorized to negotiate and execute contracts and agreements with for-profit and not-for-profit entities for the benefit of an individual park or the park system as a whole; provided, however, that the Director of Finance and Administration shall certify on such contracts or agreements that there are current funds available in this trust fund to fund the particular park enhancement in question, and provided further, that the Office of General Counsel shall approve such contracts and agreements before said contracts or agreements are executed by the parties. No single park enhancement, whether for improvements or enhanced programming, may exceed $100,000 without Council approval; any single expenditure from this trust fund in excess of $100,000 shall require prior Council approval. The Director may accept into this trust fund in-kind donations of labor and materials for the purposes set forth herein and direct the use of such donations, but the use of any in-kind donation having a value in excess of $100,000 shall require prior Council approval. No operating funds may be transferred into this trust fund unless specifically approved by Council. The Director shall administer the rules and guidelines regarding donations to this trust fund, which may include name recognition of donors consistent with the schedule set forth in the rules and guidelines. All monies and interest placed into this trust fund are hereby appropriated for the purposes of this trust fund and such appropriations shall not lapse at the close of any fiscal year, but instead shall carry over to the next fiscal year. (c) Public Information Publications Trust Fund. There is created an account to be known as the Public Information Publications Trust Fund, into which shall be deposited all funds appropriated from time to time by the Council and all publication-related monies, which shall include, but not be limited to, donations, gifts, and other fees and funds from items which are sold by the City (such as, for example, but not by way of limitation, books, calendars, posters, video products, audio products, items related to the internet, and other photographic or printed items as well as the sale of advertising in all publications of the Public Information function) and in all other forms of media, including radio, television and internet; or charged by the City or given to the City from nongovernmental sources, together with the interest thereon, to assist in defraying the operational, publication and production costs and expenses of the Public Information function-sponsored publications and productions as such publications and productions are determined by the Mayor or City Council. The Director of Finance and Administration is authorized and directed to make disbursements from this fund upon the written requisition of the Mayor, or his or her designee, and the Mayor, or his or her designee is authorized to negotiate and execute contracts and agreements with advertisers to assure successful publications through advertising; provided however, that an assistant general counsel in the Office of General Counsel shall approve such contracts and agreements as to form. No operating funds may be transferred into this trust fund unless specifically approved by City Council. All Public Information function publications-related monies and interest placed into this trust fund are hereby appropriated for the purposes of this trust fund and such appropriations (Public Information function publication-related monies and City-provided funding) shall not lapse at the close of any fiscal year, but instead shall carry over to the next fiscal year. The Mayor or his designee shall compile a report and present said report annually in the budget presentation and additionally to the Finance Committee no later than October 31 each year on the results of the fiscal year ending on September 30. (d) Neighborhood Community Events Trust Fund. There hereby is created an account to be known as the Neighborhood Community Events Trust Fund, into which shall be deposited all funds appropriated from time to time by the Council and donations and gifts from co-sponsors pursuant to Section 191.121 , Ordinance Code, together with the interest thereon, to defray the internal City costs and expenses related to Neighborhood Community Events hosted by council members pursuant to Chapter 191 , Ordinance Code. The Director of Finance and Administration is authorized and directed to make disbursements from this fund upon the written requisition of the Director of the Office of Special Events, or his designee. All monies and interest placed into this trust fund are hereby appropriated for the purposes of this trust fund and such appropriations (i.e., donations, gifts and City-provided funding) shall not lapse to the General Fund at the close of any fiscal year, but instead shall carry over to the next fiscal year. The Special Events Office, no later than 60 days after the last day of an event, shall deliver to the Director of Finance and Administration, the Council Auditor and the Council President a complete accounting of revenues by source, and expenditures by category and source on a form agreed to by the Director of Finance and Administration and the Council Auditor.
