Sec. 111.160. - Art In Public Places Trust Fund.

There is hereby created an account to be known as the Art In Public Places Trust Fund into which shall be deposited all revenues, donations or gifts which are received by the Art In Public Places Commission or the City on behalf of the Commission. The monies in this fund shall be expended pursuant to such guidelines as set forth in the Art In Public Places Program as implemented by the Commission, subject to the terms and conditions contained in any donation or gift, if any. The Director of Finance and Administration is authorized and directed to make disbursements from this fund upon the written request of the Art In Public Places Commission, subject to appropriation by City Council. If at any time the balance of this Fund drops below $1,000 for a period of more than one fiscal year, than all remaining funds may be appropriated by the Council to any public purpose. In the event that the Duval County School Board or an independent authority of the City seeks to use the program created by Part 9 of Chapter 126 , Ordinance Code, such entity may appropriate funds to this trust fund. Such monies shall be segregated for use by the appropriating entity. (a) There is hereby created the Tillie K. Fowler Memorial Artwork Trust Fund, a temporary trust fund of the City, into which monies derived from gifts, legacies or devises made to the Tillie K. Fowler Memorial Artwork Trust Fund shall be deposited. The monies in this fund shall be expended pursuant to the guidelines set forth in the Art in Public Places Program as implemented by the Art in Public Places Commission (including an allocation of ten percent of trust fund revenues for commission administrative expenses and five percent for maintenance of the artwork created). The Director of Finance and Administration is authorized and directed to make disbursements from this fund upon the written request of the Art in Public Places Commission, and disbursements from the fund are specifically authorized to be made for the commissioning, creation, installation and maintenance of an appropriate piece of public art and a commemorative plaque memorializing Tillie Fowler. Any undistributed funds shall not lapse at the close of any fiscal year, but instead shall carry over to the next fiscal year. The artwork shall be commissioned by the Art in Public Places Commission in consultation with Mrs. Fowler's immediate family. After the artwork is created and installed and all outstanding associated debt is paid off, this trust fund shall be discontinued, and any appropriated funds shall be returned to previous accounts. (b) There is hereby created a separate activity with a grant number and grant detail within the Art in Public Places Trust Fund, into which shall be paid 50 percent of the art auction sales proceeds (the "principal amount") derived from the Joan Mitchell Artwork pursuant to Ordinance 2018-193-E. The annual interest earnings on the principal amount shall be appropriated each year in the annual budget ordinance for the maintenance of the City's public art. Once appropriated, such interest earnings shall be transferred to the trust fund activity for the maintenance of the City's public art. No expenditures shall be made from the principal amount; expenditures shall only be made from annual interest earnings.
