Sec. 111.250. - Opioid Abuse Program Trust Fund.

There is hereby created the Opioid Abuse Program Trust Fund (Trust Fund), an ongoing trust fund which shall carry forward each fiscal year and not lapse. All such funds derived from donations, contributions of money, gifts and related sponsorships received by the City for use toward the general purpose of continuing the fight against opioid addiction as approved by Ordinance 2017-426-E, and as further continued by Ordinances 2018-253-E, 2018-504-E and 2018-683-E, shall be deposited into the Trust Fund. The Council shall appropriate available funds deposited into the Trust Fund. Expenditures from the Trust Fund shall be restricted to the aforementioned continuation of the effort to end opioid addiction, and if funds remain in the trust fund beyond the termination of the opioid abuse mitigation program, then funds may be used for programs to combat substance abuse and addiction, subject to the approval of the Council. Consistent with appropriations approved by City Council, the Director of Finance and Administration, or his or her designee, is authorized and directed to make disbursements from the Trust Fund for grant awards pursuant to Section 84.403, Ordinance Code, upon the written requisition of the Grants Administrator and the prior review and approval of the Chief Financial Officer, subject to the availability of appropriated funds in the Trust Fund. For grants to be awarded pursuant to Sections 84.404 and 84.405, Ordinance Code, the annual budget or separate legislation shall authorize the appropriation of funds. All disbursements made pursuant to the provisions of this Section shall be released and disbursed only subsequent to the execution by recipient of a written agreement. Grants awarded for $20,000 or less pursuant to Section 84.403, Ordinance Code, shall not exceed $200,000 cumulatively each fiscal year. Such small grants shall not require legislation but shall be disbursed only after execution of a written agreement by the recipient, subject to the Council authorizing and appropriating available funds up to $200,000 in a fiscal year.
