Sec. 111.265. - Opioid Settlement Special Revenue Fund.

There is hereby created within the General Government - Budgeted Fund a special revenue fund account to be known as the Opioid Settlement Special Revenue Fund (the "Fund") into which the City shall deposit all opioid settlement proceeds received in accordance with the terms of the Florida Memorandum of Understanding authorized and approved by Ordinance 2021-659-E (the "MOU") to which the City is a party. All sums placed into the Fund, together with any interest accrued thereon, shall only be used for the "Approved Purposes" defined and outlined in the MOU. The monies deposited in the Fund shall not lapse at the close of any fiscal year but shall carry over to the next fiscal year and shall be subject to appropriation by the Council in accordance with the terms of the MOU with the exception that funds disbursed to the cities of Jacksonville Beach, Atlantic Beach, Neptune Beach and the Town of Baldwin in accordance with the Interlocal Agreement between the City of Jacksonville, the City of Atlantic Beach, the City of Jacksonville Beach, the City of Neptune Beach, and the Town of Baldwin for Distribution of Opioid Litigation Settlement Proceeds (the "Interlocal Agreement") approved by Ordinance 2022-840-E shall be self-appropriating.
