Sec. 111.310. - Special Law Enforcement Trust Fund.

There is created a trust fund account to be known as the Special Law Enforcement Trust Fund . There shall be deposited in this fund all monies paid over to the City under F.S. § 932.7055(4) to be used only for law enforcement purposes as specified herein. Subject to appropriation by the Council in each instance, the Sheriff may expend funds from this account to provide matching funds to obtain federal grants (including grants from State agencies using money provided by the United States) and for other law enforcement purposes as are approved by the Council, and the Director of Finance and Administration is authorized and directed to make disbursements from this account upon the written requisition of the Sheriff or his designee, after approval by the Council. Effective October 1, 2001, the Sheriff is authorized to appropriate up to $10,000 per fiscal year in a designated account without further Council action to purchase security cameras for small businesses to meet the requirements of Chapter 177 , Ordinance Code. These funds shall be used to purchase cameras for small businesses pursuant to rules established by the Sheriff and shall not lapse at the end of the fiscal year. In no case whatsoever shall any of the funds in this account be considered a source of revenue to meet normal operating needs of the Office of the Sheriff, nor shall the legislative budget submitted by the Sheriff anticipate future forfeitures or proceeds therefrom which may be deposited in this fund. Pursuant to F.S. § 932.7061, annual reporting is required to the Florida Department of Law Enforcement and to the Council. The monies deposited in this trust fund shall carry over fiscal years and may be expended for the purposes of the original lawful Council appropriation; provided, that any monies deposited in the trust fund in any fiscal year which exceed the amount appropriated by the Council for the fiscal year shall not be expended until appropriated by the Council.
