Sec. 111.315. - Federal Forfeitures Trust Fund.

There is hereby created within the General Trust and Agency Fund a trust fund account to be known as the Federal Forfeitures Trust Fund. There shall be deposited in this fund all moneys paid over to the City under the Federal Department of Justice, Attorney General's Guidelines on Seized and Forfeited Property (the "Guide") to be used only for law enforcement purposes as specified therein. Subject to appropriation by the Council in each instance, the Sheriff may expend funds from this account for those purposes specified in the "Guide." the Director of Finance and Administration is authorized and directed to make disbursements from this account upon written requisition of the Sheriff or his designee, after approval by the Council. In no case whatsoever shall any of the funds in this account be considered a source of revenue to meet normal operating needs of the Office of the Sheriff, nor shall the annual budget submitted by the Sheriff anticipate future forfeitures or proceeds therefrom which may be deposited in this fund. The monies deposited in this trust fund shall carry over fiscal years and may be expended for the purposes of the original lawful Council appropriation; provided, that any monies deposited in the trust fund in any fiscal year which exceed the amount appropriated by the Council for the fiscal year shall not be expended until appropriated by the Council.
