Sec. 121.109. - Limitations on granting disability pensions.

No disability pension shall be granted to any participant for total and permanent disability if the physical or mental condition is attributable in whole or in substantial part to any of the following: (a) Chronic alcoholism; (b) Addiction to narcotic or hallucinogenic drugs (other than drugs prescribed for such person by a physician for the treatment of conditions other than drug addiction); (c) Intentionally self-inflicted wounds or conditions; (d) Injuries suffered while engaged in a felonious or criminal act or enterprise; or (e) Injuries suffered while in the employment of another employer, excluding the armed forces of the United States, which entitle the participant to disability benefits from such other employer.
