Sec. 122.109. - Prohibiting Construction of New Public Buildings When Vacant Public Buildings Exist.

It shall be the policy of the City to utilize the existing, vacant public building inventory prior to constructing any new public building or facility for public purposes. Accordingly, Council shall approve no appropriation for construction of a new public building or facility if there is an existing, vacant public building or facility which is suitable for the proposed use. In this context, the term "suitable" means that consideration shall be given to such factors as the size, scale and location of the existing public building or facility in relation to the proposed use and to the estimated costs required to make an existing public building or facility and/or its appurtenant uses (such as parking lots, additional structures, recreational areas, signage) appropriate for the proposed use. Enactment of any ordinance waiving Section 122.109 , Ordinance Code, shall require approval by at least a two-thirds majority of the Council Members present. (Ord. 2013-7-E, § 1)
