Sec. 122.310. - Forfeited motor vehicles.

(a) The Sheriff is authorized to maintain, remodel and repair motor vehicles forfeited under the provisions of the Florida Contraband Transportation Act or any future applicable State law to the use of the Sheriff's Office. The Sheriff may install or cause to be installed in the motor vehicle such equipment as he considers necessary to the performance of his duties and may remove and transfer this equipment to other motor vehicles at his discretion. (b) The Sheriff's Office shall bear the expense of maintaining, remodeling and repairing motor vehicles under this Section but the Sheriff is authorized to utilize the Sheriff's Confidential Vehicle Maintenance Fund for the acquisition, maintenance, remodeling or repair of the motor vehicles to which this Section applies. (c) The Sheriff is authorized, with the approval of the Chief of Fleet Management, to utilize private contractors in the maintenance, remodeling and repair of the motor vehicles to which this Section applies; provided, that this utilization shall be deemed utilization of contractual services and shall be subject to the Purchasing Code. (d) When the Sheriff deems it necessary or expedient to dispose of a forfeited vehicle rather than retain it for law enforcement use, he shall dispose of the vehicle according to the provisions of Florida Contraband Forfeiture Act, or any future State law controlling this disposal.
