Sec. 122.701. - Registration of service marks.

(a) The Council authorizes the Mayor to apply for registration of service marks on behalf and in the name of the City, as the owner of the service marks, with the Commissioner of Patents and Trademarks, according to the provisions of Title 15, United States Code and the rules of the United States Patent and Trademark Office applicable thereto. The Mayor may designate the General Counsel or an Assistant Counsel to represent the City in making the application; preparing, procuring any other documents required to be filed in connection with an application for registration; handling the examination and reexamination by an examiner or the Commissioner of Patents and Trademarks; taking appeals to the Trademark Trial and Appeal Board; and dealing with all other matters and proceedings involved in issuance of the certificate of registration, renewal or continued use of a service mark and the defense and protection of a service mark. (b) The legal title and every right, interest, claim or demand of any kind in and to any service mark registered under the trademark laws of the United States pursuant to the authority contained in this Section is vested in the City in its corporate, proprietary and governmental capacities and may be used by the various agencies of the City for their benefit and purposes in accordance with the provisions of this Part 7. The City owns and controls each service mark registered pursuant to this Part 7 and will exercise, through its authorized agencies, all of the normal incidents of ownership and control, including licensing the use of a service mark to other persons and the receipt and disposition of royalties. Except as provided in this Part 7, no person has authority to use, appropriate, transfer, assign, license or otherwise deal with or dispose of a service mark owned and controlled by the City.
