Sec. 154.104. - Serving persons under 21 years of age.

(a) It shall be unlawful for any owner or other person to sell, give, serve or permit to be served, alcoholic beverages to a person under 21 years of age. This Section shall not apply to the parent, legal guardian or spouse of the person under 21 who has received the alcoholic beverages. (b) (1) It shall be unlawful for any owner to permit a person under 21 years of age to possess or to consume alcoholic beverages on the owner's premises. (2) As used in this Section, owner shall mean and include the manager, owner, possessor or other person in operation or control of any premises where a person under 21 years of age possesses, purchases, receives or consumes alcoholic beverages; however, owner shall not include the parent, legal guardian or spouse of the person under 21 years of age. (c) As used in this Section, person shall mean any natural person, firm, association, partnership, corporation or any other entity. (d) Upon the first conviction for violation of this Section, the convicted person shall be punished by a fine of $500 and 72 hours of community service. (e) Upon the second conviction for violation of this Section, the convicted person shall be punished with a fine of $500 and 144 hours of community service. (f) Upon the third and subsequent convictions for violation of this Section, the convicted person shall be punished with a fine of $500 and 144 hours of community service and from three to 30 days' imprisonment. (g) This Section shall not apply to the use of alcoholic beverages at constitutionally protected religious observances. (h) All acts of any servants, agent or employee, paid or unpaid, of an owner shall be imputed to the owner and be deemed to be an act of the owner if done within the scope of such servant, agent or employee's scope of authority under the owner.
