Sec. 250.124. - Penalty to property owner who allows persons onto his or her property to vend without proper permit.

Unless otherwise set forth in this Chapter, it is unlawful for any private property owner to allow a person or entity to sell or offer for sale food, services or merchandise, or engage in any businesses, activities or conduct regulated by this Chapter, on land owned by the private property owner, without the vendor first obtaining a transient vendor permit or other appropriate permit to vend on private property. The private property owner shall maintain a copy of a current and valid transient vendor permit, or other applicable permit for vending on private property, for his or her records and shall produce same upon request of Jacksonville Sheriff's Office or the Neighborhoods Department Coordinator (or his or her successor to enforcement activities). The vendor shall also maintain a copy of the current and valid permit on the property at all times while vending activities are occurring, and shall produce it upon request. This Section shall not apply to a property owner who allows temporary, limited use of their property for fundraising activities or other de minimis uses that occur for a maximum total of 5 days during any one calendar year, which days may or may not occur consecutively. Such de minimis fundraising activities and uses may include, but are not limited to, car washes, bake sales, lemonade stands or other means utilized by bona fide schools, churches, non-profits or individuals that are not intended for commercial profit. Chapter 609 , Ordinance Code, shall govern the issuance of citations under this Section. A violation of this provision shall be punishable as for a Class E offense pursuant to Section 609.109 , Ordinance Code. (Ord. 2013-373-E, § 1; Ord. 2016-140-E , § 16)
