Sec. 250.403. - Disposition of deposit.

Each deposit made with the Tax Collector shall be turned over to the Treasurer for safekeeping and shall be subject to attachment and execution on behalf of creditors whose claims arise in connection with business done in the City, and to the payment of fines and penalties incurred by the permittee through violation of this Part. Claims under civil process shall be enforced against the Treasurer as garnishee or trustee according to law. A claim for satisfaction of fines and penalties shall be enforced by the collecting officer serving notice of action and judgment, when obtained, upon the Treasurer. Claims upon each deposit shall be satisfied after judgment in the order in which notice of claim is received by the Treasurer until such claims are satisfied or the deposit is exhausted. Notices filed after the expiration of 60 days following the date of termination or revocation of the permit shall not be valid. A deposit shall not be returned by the Treasurer to the permittee as long as there are outstanding claims or notices against it, unless there is unreasonable delay in enforcing them.
