Sec. 307.202. - Standing.

The following may appeal any final order of the Historic Preservation Commission with respect to an application for a certificate of appropriateness. (a) The person who filed the application for certificate of appropriateness. (b) Any person who owns, lives or operates a business on property within 350 feet of property which is granted or denied a certificate of appropriateness; (c) Any adversely affected person, other than a council member, who provided a qualifying written statement to or testified before the Historic Preservation Commission. As used herein, the term "adversely affected person" means any person who is suffering or will suffer an adverse effect to an interest protected or furthered by this Chapter 307 . The alleged adverse effect may be shared in common with other members of the community at large, but must exceed in degree the general interest in community good shared by all persons. Also as used herein, the term "qualifying written statement" means a statement in writing which expresses a position on the merits of the application, other than a petition, such as a letter, a memo or an e-mail, which contains a reference to a specific application number and the name and mailing address of the person making the statement, is specifically addressed to the Chief of the Comprehensive Planning Division or any member of the historic preservation staff or the Commission, with a copy to the Chief of the Comprehensive Planning Division, and which is delivered to and received by the Department by hand delivery, mail, facsimile or e-mail at least two working days prior to the public hearing at which final action is taken by the Commissioners or which is read into the record at the public hearing or distributed to the Commission at the hearing with a copy to the staff secretary.
