Sec. 360.110. - Confidential records; secret processes.

To the extent permitted by law, information relating to secret processes, methods of manufacture or production which may be required, ascertained or discovered by inspection or investigation shall not be disclosed in public hearings and shall be kept confidential by the Director, employees of the Division and members and authorized representatives of the Board; provided, that nothing herein shall be construed to prevent the use of these records in judicial proceedings, so long as they are filed under the seal of the court, in connection with the prosecution of violations of this Chapter or of Chapters 362 , 368 and 376, of an attainment plan or compliance plan or of the rules or an order of the Board when ordered to be produced by appropriate subpoena or by order of the court. No subpoena or order of the court shall abridge or alter the rights or remedies of persons affected in the protection of trade secrets or secret processes in the manner provided by law and the persons affected may take any steps available by law to protect the trade secrets or processes.
