Sec. 360.407. - Judicial remedy.

In addition to other remedies and notwithstanding the existence of an adequate remedy at law, the Director or the Board, in the name of the City, is authorized to make application for an injunction to the Circuit Court. The court shall have jurisdiction, upon a hearing and for sufficient cause shown, to grant a permanent injunction restraining a person from violating or continuing to violate Chapter 362 , Chapter 368 or Chapter 376 , an attainment plan or compliance plan or the rules of the Board or from failing or refusing to comply with the requirements of an attainment plan or compliance plan, the rules of the Board or an order entered by the Board. The City shall be entitled to reasonable attorney's fees and costs, including appellate fees and costs in an action where the City is successful in obtaining affirmative relief.
