Sec. 360.503. - Activities pursuant to attainment plan or compliance plan.

No person shall be liable under this Chapter for damages as a result of actions taken or omitted in the course of rendering care, assistance or advice in accordance with an attainment plan or an applicable compliance plan or at the direction of an on-scene coordinator appointed under a plan, with respect to an incident creating a danger to public health or welfare or the environment as a result of an action that resulted or may result in a release or threat of release of a hazardous substance, pollutant or contaminant. This Section shall not preclude liability for damages as the result of gross negligence or intentional misconduct on the part of the person. For the purpose of the preceding sentence, reckless, wilful or wanton misconduct shall constitute gross negligence. (Ord. 84-674-684, § 1)
