Sec. 360.504. - Indemnification, hold harmless, etc., agreements or conveyances; subrogation rights.

(a) No indemnification, hold harmless or similar agreement or conveyance shall be effective to transfer from the owner or operator of a facility or from any person who may be liable for an action that constitutes a violation of Chapter 362 , Chapter 368 or Chapter 376 , an attainment plan or compliance plan, the rules or an order of the Board entered pursuant to Section 360.408 , to any other person the liability imposed under this Chapter. Nothing in this subsection shall bar an agreement to insure, hold harmless or indemnify a party to the agreement for a liability under this Chapter. (b) Nothing in this Chapter, including the provisions of subsection (a) of this Section, shall bar a cause of action that an owner or operator or another person subject to liability under this Chapter, or a guarantor, has or would have, by reason of subrogation or otherwise, against any person.
