Sec. 360.802. - Prohibition.

(a) It is unlawful and a violation of this Part for any person to engage or assist in open burning or to allow open burning on property owned or controlled by such person, unless such open burning is specifically allowed by State rules or by rules of the Board. (b) Any person violating any provision of this Part shall be liable for all damages caused by such violation, which damages shall be recoverable in any court of competent jurisdiction. The civil liability shall obtain whether there be criminal prosecution and conviction or not. Damages shall include but not be limited to the cost of the Fire and Rescue Department responding to any fire caused by such violation. (Ord. 97-539-E, § 4)
