Sec. 654.114. - Design standards: right-of-way protection.

(a) Right-of-way protection. Where a subdivision abuts or contains an existing street of inadequate right-of-way width, additional right-of-way shall be required for new subdivisions. In such cases, the minimum right-of-way by roadway classification will be determined on the basis of the above table in Section 654.113 . The difference between the width of the existing right-of-way, and the minimum right-of-way width will be determined by subtracting one from the other. If it is determined that the established minimum right-of-way exceeds the width of the existing right-of-way the difference will be halved and added to the required yard setback on each side of the roadway.
