Sec. 655.405. - Minimum requirements for a CCAS or CRC approval for public schools.

For public school concurrency, one of the following must be met: (a) Adequate school capacity to serve the development (or anticipated phase(s) of the development which will be constructed in the first three years) will be in place or under actual construction within 3 years after the issuance of final subdivision or site plan approval, or the functional equivalent and the applicant has applied for and received a CCAS/CRC or has entered into a non-mitigation capacity reservation Development Agreement pursuant to Section 655.410 ; or (b) A legally binding Mitigation Agreement between the applicant, the DCPS, and the City has been executed as provided herein.
