Sec. 656.107. - Conflicting provisions; protection of civil rights.

(a) It is not the intent of the provisions of the Zoning Code to interfere with or abrogate or annul any easement, covenant or other agreement between parties; provided, however, that when the regulations of the Zoning Code impose a greater restriction upon the use of buildings or land, or upon the height of buildings, or require larger open spaces than are imposed or required by other ordinances, rules, regulations or by easements, covenants or agreements, the provisions of this Chapter shall control. (b) It is the intent of the City that all regulations of the Zoning Code be applied and interpreted so as to protect and be consistent with civil rights recognized by the U.S. and Florida Constitutions, ordinances and laws, including the Jacksonville Fair Housing Ordinance, the Rehabilitation Act of 1973, the U.S. Fair Housing Act, the U.S. Civil Rights Acts of 1964 and 1968, the Religious Land Use and Institutionalized Persons Act of 2000, and the Americans with Disabilities Act as such laws may be amended from time to time. Employees of the Planning and Development Department, including the Planning Director, employees of the Office of the General Counsel, and the Planning Commission are directed to avoid any and all interpretations or applications of the Zoning Code which would unlawfully infringe upon the civil rights of any person.
