Sec. 674.401. - Major violations: disaster preparedness.

Section: 674.401.

A person who, knowingly and wilfully: (a) Fails or refuses to perform a duty imposed upon him by an emergency preparedness plan or required of him by an order issued by the Mayor or issued at the direction of the Mayor, during an actual, impending, mock or practice disaster; or (b) Fails or refuses to go to his assigned place of duty during an actual, impending, mock or practice disaster or, having gone to such place of duty, to remain there until and unless relieved, dismissed or reassigned by competent authority; or (c) Fails or refuses to obey, observe or enforce the provisions of any order, directive or regulation issued by the Mayor or issued at the direction of the Mayor pursuant to his emergency powers under Section 674.207 ; or (d) Fails or refuses to participate in or to perform his assigned duties as a member of an emergency preparedness support force within or without the City, or to go outside the City as a member of an emergency preparedness support force; or (e) Obstructs, interferes with or prevents, or procures the obstruction, interference with or prevention of: (1) The enforcement, observance or execution of or compliance with any part of an emergency preparedness plan or with an order, directive or regulation issued by the Mayor or issued at the direction of the Mayor; or (2) The performance of a duty or the exercise of a power by an officer, employee or agent of the City or a emergency preparedness worker, during an actual, impending, mock or practice disaster; Shall be guilty of a class D offense. For offenses that are of a continuing nature, each day the offense continues shall constitute a separate offense.
