Sec. 710.101. - Grant of authority.

(a) The Council herein sets forth the conditions for the grant of a nonexclusive right, privilege and franchise to construct, operate and maintain a cable television system for the City and for residents, the system to be located in, upon, along, across, over and under the streets and roads of the City and all extensions and additions thereto for a period not to exceed 15 years (it being understood that extensions to existing franchises shall not extend the Franchise Agreement beyond 20 years from the effective date of such extension) commencing with the effective date of the Franchise Agreement issued pursuant to this Chapter, subject to the rights, obligations, conditions and restrictions as hereinafter provided and as provided in the written Franchise Agreement referencing and incorporating this Chapter (the "Franchise Agreement"). Should there be a conflict between the terms of this Chapter and the Franchise Agreement, the Franchise Agreement shall prevail. (b) The Council retains authority to provide for the regulation and control of the cable television system as prescribed herein in accordance with Federal and State law subsequent to the award of the franchise and the Council and the City retain the authority to review the performance of the franchisee periodically for compliance with the Franchise Agreement. (c) The City assumes jurisdiction, to the fullest extent allowed by law, to enforce all laws and regulations relating to cable television service in the City. (Ord. 2003-188-E, § 1)
