Sec. 711.102. - Intent.

Section: 711.102.

It is the intent of the City to provide a an application process for each and every instance in which any person (hereinafter defined) desiring to occupy any City rights-of-way (hereinafter defined) may, or may not, do so pursuant to an application (hereinafter defined) review process in which the application is approved/denied by the rights-of-way committee (hereinafter defined) in order to be protective of the public convenience and public investment and public property interests in said rights-of-way. Concerns as to the type of use, location of the use, City plans for the rights-of-way, and compliance with any City regulations (e.g. Downtown Master Plan, etc.) are intended to be factors to be considered in this application review process. Where other Sections of the City Code set forth the required contents of a permit application, for example and not by way of limitation, Section 711.406 (3), only said Sections (not Section 711.105 (a)(2) in this Part 1) shall apply to the contents of the permit application, and this Part 1 shall only require that the permit application be reviewed by the rights-of-way committee as provided in this Part 1.
