Sec. 711.106. - Waiver of fees; assessment of costs.

No fee for the application shall be required by the Director. However, in the event any administrative costs and other expenses are incurred by the City as a result of a person's failure to provide accurate information or to otherwise fail to comply with this Chapter, the Director may assess a person with said costs/expenses (to include interest and any legal costs to the City) and may, consistent with all applicable law, deny all applications until said costs are paid by the person. In the event a review of an application is determined by the Director to necessitate obtaining certain data to assist in said review (e.g. detailed engineering data, etc.), the Director shall secure all costs for the data from the person, or alternatively, require the person to obtain the data necessary to review the application. Should the person be unwilling to incur the costs related to additional data deemed necessary by the Director, the Director shall deny the application. (Ord. 2001-427-E, § 2)
