Sec. 711.401. - Applicability.

This Part shall apply to any Person, other than a governmental entity or agency unless such entity or agency is engaged in the commercial business of providing Communication Services to third-party consumers, who seeks to transmit Communication Services or to construct, place, install, maintain, Collocate or operate a Communication Facility in the City Rights-of-Way, unless otherwise exempt by operation of Applicable Codes, or State or Federal laws or regulations. In adopting this Part, the Council hereby finds that these reasonable rules, regulations and objective design standards are necessary for the proper and effective management of the City's Rights-of-Way.
