Sec. 711.409. - Existing communications facilities in City rights-of-way.

A Communications Services Provider with an existing Communications Facility in the City's Rights-of-Way shall be deemed a legal non-conforming use and may remain in non-conforming status unless such Communication Facility is altered in any way other than Limited Work. As a legal non-conforming use, the owner of the existing Communications Facility need not register or obtain a Permit for such Communications Facility until such time as the Communication Facility is altered in any way other than Limited Work. In such an event, the Communication Facility shall be brought into full compliance with all applicable standards. Failure of a Registrant to comply with this Part shall be a violation of this Part.
