Sec. 711.414. - Enforcement Remedies.

(a) A Registrant's failure to comply with provisions of this Part shall constitute a violation of this Chapter and shall subject the Registrant to the code enforcement provisions and procedures as provided in the City Code provisions on code enforcement, including prosecution before the City's Special Magistrate, issuance of a civil citation or initiation of a civil lawsuit in a court of competent jurisdiction to levy civil penalties and injunctive relief. For violations of a continuing nature, each date a violation exists shall constitute a separate violation separately enforceable. In the event the City is required to prosecute any claim in court, the City is entitled to recover its attorney's fees and costs for successful prosecutions. Violations of this Part may be punishable as a class D offense by a fine not to exceed $500. (b) Failure of the City to enforce any requirements of this Part shall not constitute a waiver of the City's right to enforce that violation or subsequent violations of the same type or to seek appropriate enforcement remedies. (c) The Director shall be responsible for administration and enforcement of this Part and is authorized to give any notice required herein or by law. (Ord. 2017-863-E , § 4)
