Sec. 711.420. - Permit application.

(a) Contents. A Registrant requesting to place a new or replace an existing Underground Communications Facility in the City's Rights-of-Way must submit an Application in the format prescribed by the Director (e.g., font size, typed/handwritten, original or electronic copies, disc copies, etc.) at no cost to the City. The Application must include at a minimum the following information and documentation: (1) A plan showing the location of the proposed Underground Communications Facility, including a description of the Underground Communications Facility to be installed, where it is to be located, and the approximate size of facilities that will be located in City Rights-of-Way. If the plans so provided require revision based upon actual installation, the Registrant shall promptly provide revised plans. The plans shall be in a hard copy format or an electronic format specified by the City, provided such electronic format is maintained by the Registrant; (2) A description of the manner in which the Underground Communications Facility will be installed (i.e. anticipated construction methods or techniques); (3) A maintenance of traffic plan for any disruption of the City's Rights-of-Way; (4) Information on the ability of the City's Rights-of-Way to accommodate the proposed Underground Communications Facility, if available (such information shall be provided without certification as to correctness, to the extent obtained from other Persons); (5) If appropriate given the Underground Communications Facility proposed, an estimate of the cost of restoration to the City's Rights-of-Way; (6) The timetable for construction of the Underground Communications Facilities or each phase thereof, and the areas of the City's which will be affected; (7) A notarized statement from Registrant that the Underground Communications Facilities are in compliance with the Applicable Codes; (8) Evidence of the performance bond and Surety Fund required under Subpart A of this Part; (9) In such instances where a contractor or other agent is acting on behalf of the Registrant, evidence such as an executed letter or notarized statement by Registrant granting authority to such contractor or other agent to act on the Registrant's behalf; and (10) Such additional information as the City finds reasonably necessary with respect to the placement or maintenance of the Underground Communications Facility that is the subject of the permit application, to review such permit application. (b) Required notification of incomplete Application by City. Within 30 days after receipt of information and documentation submitted by the Applicant, the Director shall determine whether the Application contains all information and required documentation and shall advise the Applicant in writing of any deficiencies. Applicant shall re-submit any deficient information and documentation within 30 days of the date of the notice of deficiency, otherwise the Application shall be denied. A notice of deficiency or denial of Permit shall not preclude an Applicant from filing subsequent Permit applications under this Subpart B. An Application that fails to include any of the required information and documentation above shall not be processed until such Application is complete. (c) Review and approval. Applications for Permits submitted by a Registrant under this Subpart B shall be approved or denied in accordance with the provisions of Section 711.105 (b)(2) of this Chapter. (Ord. 2017-863-E , § 4)
