Sec. 780.331. - Appeals to Commission.

(a) Within five days following receipt of notice that the Director has denied a preconstruction application or a final application, the applicant may file an appeal from the determination to the Commission. The appeal shall be filed on a form prepared by the Director. Included with the form shall be a copy of any recommendations made by the Director. (b) The Commission shall review the qualifying improvement project in substantially the same manner as in a review of a certificate of appropriateness as specified in Chapter 307 . A public hearing shall be held and notice provided the applicant. The standards for review contained in Section 780.333 shall be criteria applied by the Commission in hearing the appeal.
