Section 1 of Laws of Fla., Ch. 91-362 provided that: (a) Notwithstanding the provisions of section 2 of chapter 89-439, Laws of Florida, and section 1 of chapter 91-362, Laws of Florida, sections 1 and 3 of chapter 89-439, Laws of Florida, shall not terminate and be of no further force and effect on October 1, 2001, as scheduled by such acts, but sections 1 and 3 of chapter 89-439, Laws of Florida, as amended by section 2 of chapter 91-362, Laws of Florida, shall continue to exist and operate. (b) In all proceedings involving air or water pollution in which the City of Jacksonville Environmental Protection Board seeks to impose a penalty, it shall, at the option of the citizen, follow the procedures described in sections 120.569 and 120.57, Florida Statutes, including, when appropriately requested, the hiring of administrative law judges within the Division of Administrative Hearings to preside over disputed cases.
