Section 1. - [Powers.]

In addition to any other powers authorized by general law, special or local act or ordinance, the council of the City of Jacksonville is specifically authorized to grant, by ordinance, necessary powers to the City of Jacksonville Environmental Protection Board, including, but not limited to: 1. Promulgate rules necessary for the implementation, administration, and enforcement of City of Jacksonville ordinances relating to environmental protection. 2. Hold hearings, conduct investigations, and take testimony in all matters relating to environmental protection. 3. Hold hearings, perform studies, and investigate pollution control programs, and devices, to advise the city council and mayor on pertinent issues relating to environmental protection, regulation and control, and enforcement practices. 4. Enforce the provisions of environmental protection ordinances of the city, and rules promulgated by the board, including issuing appropriate orders to ensure compliance with board rules, the City of Jacksonville Ordinance Code, and the laws of Florida. 5. When necessary, order the posting of bonds by persons subject to the jurisdiction of the board, up to a maximum of $50,000, to ensure compliance with the orders of the board. 6. Assess a civil penalty, in such amounts and within the limits prescribed by the City of Jacksonville Ordinance Code, to be paid to the environmental protection fund for violation of the City of Jacksonville Ordinance Code, or board order, or for failure to comply with a board order; provided, however, that if the assessment of a civil penalty is appealed to a court of competent jurisdiction by a party against whom the civil penalty was assessed and the imposition of the assessment is reversed upon such appeal, the city shall be liable for and shall pay all of that party's attorney's fees not to exceed five thousand dollars ($5,000.00). 7. Exercise and perform such other and further powers, duties, and authority as may be provided in the City of Jacksonville Ordinance Code. (Laws of Fla., Ch. 91-362, § 2)
