Landscape area trust fund established
Section: 16-101
(a)
There are hereby established seven (7) separate landscape area trust funds for each of the seven (7) separate landscape districts described in subsection 13-161(e) of Chapter 13, Landscaping, Tree Removal, and Site Clearing Code. The landscape area trust funds shall be used for the deposit, maintenance, and distribution of all monetary contributions made in lieu of providing the required landscape area for developments pursuant to section 13-161. All contributions made to and interest derived from any of the landscape area trust funds shall be used solely for the purpose of acquiring new park land and/or improving existing public park lands and/or public right-of-way by providing, enhancing, or reestablishing green space solely within the boundaries of the landscape district in which the contribution was collected.
(b)
The landscape area trust fund fee shall be established by city council resolution. The amount of the payment shall be determined by dividing the total assessed land value, according to the current records of the Hillsborough County Property Appraiser's Office, in the individual district by the total land area for that individual landscape district times the square foot reduction of landscape area.
(c)
Contributions must be spent within five (5) years of their collection. If sufficient funds are not collected within an individual landscape district to acquire new park land or improve existing public park lands or public right-of-way by providing green space, the department shall present an alternative plan to city council. City council may approve the alternative plan if it is determined that the proposed use of funds is improving the public landscaped area in the district for which the funds were collected.
