Applicability

(a)

This division relates to abandoned and vacant property that is or has been subject to a mortgage determined by the mortgagee to be in default.

(b)

This division will not apply to dwellings and structures located within a multi-family structure if:

(1)

The multi-family structure has a property manager on the premises; and

(2)

The multi-family structure has an active owners' association responsible for the management and maintenance of the property.
